AN ACT

 

1Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2Statutes, in general provisions, further providing for
3definitions and providing for charging Internet convenience
4fee.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 103 of Title 62 of the Pennsylvania
8Consolidated Statutes is amended by adding a definition to read:

9§ 103. Definitions.

10Subject to additional definitions contained in subsequent
11provisions of this part which are applicable to specific
12provisions of this part, the following words and phrases when
13used in this part shall have the meanings given to them in this
14section unless the context clearly indicates otherwise:

16"Internet convenience fee." An additional fee for an online
17transaction of an executive agency, including, but not limited

1to, a fee for ordering an online search or an online filing of
2any application, license, permit, registration or form, if the
3fee is separate from and in addition to the fee for the same
4search, application, license, permit, registration or form when
5the transaction is made in person or by mail. The term shall
6also include any additional online fee for a person to use a
7credit card, debit card or electronic transfer from a checking
8account in paying for an online search or an online filing of
9any application, license, permit, registration or form.

11Section 2. Title 62 is amended by adding a section to read:

12§ 109. Internet convenience fee.

13No contract pursuant to this title shall authorize and no
14executive agency is permitted to establish any Internet
15convenience fee without specific authorization from the General
16Assembly. This limitation shall not preclude any type of credit
17card or debit card processing fee for the payment of any type of
18tax or fee to the Department of Revenue or the Pennsylvania
19Public Utility Commission or for the payment of any fine or
20penalty to an executive agency.

21Section 3. This act shall take effect in 60 days.
