1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for definitions;
6and prohibiting strip searches by school employees.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1301-A of the act of March 10, 1949
10(P.L.30, No.14), known as the Public School Code of 1949, is
11amended by adding definitions to read:

12Section 1301-A. Definitions.--As used in this article,

14"School employe" shall include any teacher, substitute
15teacher, principal, assistant principal, vice-principal,
16director of vocational education, school counselor,
17superintendent and all other employes.

19"Strip search" shall mean a search in which a person's
20genitals, pubic area, buttock or anus or a female person's

1breast is either uncovered or exposed to view or is touched by a
2person conducting the search.

4Section 2. The act is amended by adding a section to read:

5Section 1314-A. Strip Search by School Employe.--A school
6employe is prohibited from conducting a strip search of any
7pupil.

8Section 3. This act shall take effect in 60 days.
