1Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2Statutes, further providing for required licenses.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 5703(b)(2) of Title 3 of the Pennsylvania
6Consolidated Statutes is amended by adding subparagraphs to
7read:

8§ 5703. License required.

10(b) Exempt retail food facilities.--

12(2) A licensor shall exempt the following retail food
13facilities from the license requirements of this section:

15(iv) A retail food facility owned by a charitable
16nonprofit entity that operates on no more than 12 days

1each calendar year.

2(v) A retail food facility under paragraph (1)(vii)
3that operates on no more than 12 days each calendar year.

4A retail food facility that is exempted from the license
5requirements under this section shall remain subject to
6inspection and all other provisions of this subchapter.

8Section 2. This act shall take effect in 60 days.
