AN ACT
1Amending Title 35 (Health and Safety) of the Pennsylvania
2Consolidated Statutes, in emergency telephone service,
3providing for prohibited release of information.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Title 35 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:
8§ 5399. Prohibited release of information.
9(a) Prohibition.--Notwithstanding any other law, in a
10response to a request for a record under <-section 708(b)(18) of
11the act of February 14, 2008 (P.L.6, No.3), known as the Right-
12to-Know Law, a PSAP may not release a <-public record or part of a
<-13public record containing identifying information related to an
14individual calling a 911 center <-unless a court of competent
15jurisdiction determines that the public interest in disclosure
16outweighs the interest in nondisclosure.
1(b) Definition.--As used in this section, the term
2"identifying information" includes name, telephone number,
3address and location.
4Section 2. This act shall take effect in 60 days.
