AN ACT

 

1Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
2"An act concerning elections, including general, municipal,
3special and primary elections, the nomination of candidates,
4primary and election expenses and election contests; creating
5and defining membership of county boards of elections;
6imposing duties upon the Secretary of the Commonwealth,
7courts, county boards of elections, county commissioners;
8imposing penalties for violation of the act, and codifying,
9revising and consolidating the laws relating thereto; and
10repealing certain acts and parts of acts relating to
11elections," in dates of elections and primaries and special
12elections, further providing for affidavits of candidates;
13and, in nomination of candidates, further providing for
14affidavits of candidates.

15The General Assembly of the Commonwealth of Pennsylvania
16hereby enacts as follows:

17Section 1. Sections 630.1 and 981.1 of the act of June 3,
181937 (P.L.1333, No.320), known as the Pennsylvania Election
19Code, amended May 12, 2006 (P.L.178, No.45), are amended to
20read:

21Section 630.1. Affidavits of Candidates.--Each candidate for
22any State, county, city, borough, incorporated town, township,
23school district or poor district office, or for the office of

1United States Senator or Representative in Congress, selected as
2provided in section 630 of this act, shall file with the
3nomination certificate an affidavit stating--(a) his residence,
4with street and number, if any, and his post-office address; (b)
5his election district, giving city, borough, town or township;
6(c) the name of the office for which he consents to be a
7candidate; (d) that he is eligible for such office; (e) that he
8will not knowingly violate any provision of this act, or of any
9law regulating and limiting election expenses and prohibiting
10corrupt practices in connection therewith; (f) unless he is a
11candidate for judge of a court of common pleas, the Philadelphia
12Municipal Court or the Traffic Court of Philadelphia[, or for
13the office of school board in a district where that office is
14elective] or for the office of justice of the peace, that he is
15not a candidate for the same office of any party or political
16body other than the one designated in such certificate; (g) that
17he is aware of the provisions of section 1626 of this act
18requiring election and post-election reporting of campaign
19contributions and expenditures; and (h) that he is not a
20candidate for an office which he already holds, the term of
21which is not set to expire in the same year as the office
22subject to the affidavit.

23Section 981.1. Affidavits of Candidates.--Each candidate for
24any State, county, city, borough, incorporated town, township,
25ward, school district, poor district or election district
26office, or for the office of United States Senator or
27Representative in Congress, selected as provided in sections 979
28and 980 of this act, shall file with the substituted nomination
29certificate an affidavit stating--(a) his residence, with street
30and number, if any, and his post-office address; (b) his

1election district, giving city, borough, town or township; (c)
2the name of the office for which he consents to be a candidate;
3(d) that he is eligible for such office; (e) that he will not
4knowingly violate any provision of this act, or of any law
5regulating and limiting election expenses and prohibiting
6corrupt practices in connection therewith; (f) unless he is a
7candidate for judge of a court of common pleas, the Philadelphia
8Municipal Court or the Traffic Court of Philadelphia[, or for
9the office of school board in a district where that office is
10elective] or for the office of justice of the peace, that he is
11not a candidate for the same office of any party or political
12body other than the one designated in such certificate; (g) that
13he is aware of the provisions of section 1626 of this act

19Section 2. This act shall take effect in 60 days.
