1Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
2Statutes, in development, further providing for well permits,
3for general gas storage reservoir operations and for
4regulations.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 3211 of Title 58, added February 14, 2012 
8(P.L.87, No.13), of the Pennsylvania Consolidated Statutes is 
9amended by adding a subsection to read:

10§ 3211. Well permits.

12(b.3) Pennsylvania Turnpike Commission.--If the applicant
13intends to use or establish a gas transmission line in the
14Pennsylvania Turnpike's right-of-way, then the applicant must
15attach a copy of the expected fee arrangement between the
16applicant and the Pennsylvania Turnpike Commission.

18Section 2. Sections 3233(f)(1) and 3274 of Title 58, added 
19February 14, 2012 (P.L.87, No.13), are amended to read:

1§ 3233. General gas storage reservoir operations.

3(f) Duty of storage reservoir operator.--The following shall
4apply:

5(1) A person owning or operating a storage reservoir
6subject to this chapter shall have a duty to:

7(i) Maintain all wells drilled into or through the
8reservoir in a condition and operate them in a manner
9sufficient to prevent the escape of gas.

10(ii) Operate and maintain the reservoir and its
11facilities as prescribed by departmental regulations and
12at a pressure which will prevent gas from escaping, but
13the pressure shall not exceed the highest rock pressure
14found to have existed during the production history of
15the reservoir or another high pressure limit approved by
16the department after holding a conference under section
173251 based on geological and production knowledge of the
18reservoir, its character, permeability distribution and
19operating experience.

20(iii) Have a valid fee arrangement with the
21Pennsylvania Turnpike Commission for any use of gas
22transmission lines that are in the Pennsylvania
23Turnpike's right-of-way.

25§ 3274. Regulations.

26(a) Environmental Quality Board.--The Environmental Quality
27Board shall promulgate regulations to implement this chapter.

28(b) Pennsylvania Turnpike Commission.--The Pennsylvania
29Turnpike Commission shall adopt regulations relating to
30commercial use of the turnpike's right-of-way for gas

1transmission lines under this chapter, including setting a fee
2structure.

3Section 3. This act shall take effect in 60 days.
