AN ACT

 

1Requiring well operators to provide complete water analysis
2results to the Department of Environmental Protection under
3certain circumstances.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Short title.

7This act shall be known and may be cited as the Water
8Analysis Information Act.

9Section 2. Definitions.

10The following words and phrases when used in this act shall
11have the meanings given to them in this section unless the
12context clearly indicates otherwise:

13"Department." The Department of Environmental Protection of
14the Commonwealth.

15"Well operator." As defined in 58 Pa.C.S. § 3203 (relating
16to definitions).

17Section 3. Complete water analysis results to be provided.

1(a) Duty of well operator.--A well operator who analyzes or
2enters into a contract with an independent certified laboratory
3to analyze a public or private water supply before, during or
4after drilling or alteration of an oil or gas well in accordance
5with 58 Pa.C.S. § 3218 (relating to protection of water
6supplies), shall provide the complete analysis results,
7including all data and documentation of the analysis to the
8department within five days of receipt of the analysis results.

9(b) Duty of department.--The department shall provide
10complete analysis results, including all data and documentation
11of a public and private water supply analysis conducted in
12accordance with 58 Pa.C.S. § 3218(e), including all results
13received under subsection (a) and analyses conducted by or at
14the request of the department. This information shall be made
15available at no cost to the landowner or water purveyor of the
16water supply within ten business days upon receipt of a written
17request by the landowner or water purveyor.

18Section 4. Effective date.

19This act shall take effect in 60 days.
