AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for immediate notice of accident
3to police department.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3746 of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 3746. Immediate notice of accident to police department.

9(a) General rule.--The driver of a vehicle involved in an
10accident shall immediately by the quickest means of
11communication give notice to the nearest office of a duly
12authorized police department if the accident involves:

13(1) injury to or death of any person; or

14(2) damage to any vehicle involved to the extent that it
15cannot be driven under its own power in its customary manner
16without further damage or hazard to the vehicle, other
17traffic elements, or the roadway, and therefore requires
18towing.

1(b) Duty of occupant if driver disabled.--Whenever the
2driver of a vehicle is physically incapable of giving an
3immediate notice of an accident as required in subsection (a)
4and there is another occupant in the vehicle at the time of the
5accident capable of doing so, the occupant shall make or cause
6to be given the notice not given by the driver.

7(c) Investigation by police officer.--Every accident
8reported to a police department [required in this section] shall
9be investigated by a police officer who shall physically report 
10to the scene of the accident and shall provide each driver a
11signed statement that the accident was reported.

12Section 2. This act shall take effect in 60 days.
