AN ACT

 

1Amending the act of March 4, 1970 (P.L.128, No.49), entitled "An
2act granting to the Governor of the Commonwealth the sole
3authority for regulating the display of the flag of the
4United States from any public ground or building and from any
5ground or building of certain other institutions," further
6providing for the display of the official POW/MIA flag.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1(d) of the act of March 4, 1970
10(P.L.128, No.49), entitled "An act granting to the Governor of
11the Commonwealth the sole authority for regulating the display
12of the flag of the United States from any public ground or
13building and from any ground or building of certain other
14institutions, added February 10, 1994 (P.L.70, No.5), is amended
15and the section is amended by adding subsections to read:

16Section 1. * * *

17(d) In addition to any other powers and duties imposed by
18this section, the Governor shall [permit]:

1(1) Require the display of the official POW/MIA flag from
2the flagpoles of the following public buildings:

3(i) Each county courthouse.

4(ii) The Department of Military and Veterans Affairs.

5(iii) Other large State office buildings to be determined by
6the Governor.

7(iv) The State Capitol.

8(2) Permit the display of the official POW/MIA flag from the
9flagpoles of any other public building or ground in this
10Commonwealth.

11(e) Notwithstanding any other provision of law, when
12displayed with the United States flag on a single staff, a
13POW/MIA flag shall be displayed below the flag of the
14Commonwealth. When flags are displayed on multiple staffs, the
15flag of the Commonwealth shall be displayed to the honor of the
16United States flag.

17(f) The display of a POW/MIA flag in accordance with this
18section shall be in a manner designed to ensure that the flag is
19visible to the public.

20Section 2. This act shall take effect in 60 days.
