1Amending Title 66 (Public Utilities) of the Pennsylvania
2Consolidated Statutes, in rates and distribution systems,
3further providing for customer protections.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1358(a)(1) of Title 66 of the
7Pennsylvania Consolidated Statutes, added February 14, 2012
8(P.L.72, No.11), is amended to read:

9§ 1358. Customer protections.

10(a) Limitation.--As follows:

11(1) Except as provided under paragraph (2), the
12distribution system improvement charge may not exceed 5% of
13the amount billed to customers under the applicable rates of
14the wastewater utility or distribution rates of the electric
15distribution company, natural gas distribution company or
16city natural gas distribution operation. [The commission may
17upon petition grant a waiver of the 5% limit under this
18paragraph for a utility in order to ensure and maintain

1adequate, efficient, safe, reliable and reasonable service.]
