AN ACT
1Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
2Statutes, further providing for well location restrictions.
3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:
5Section 1. Section 3215(b)(4) of Title 58 of the
6Pennsylvania Consolidated Statutes, added February 14, 2012
7(P.L.87, No.13), is amended to read:
8§ 3215. Well location restrictions.

10(b) Limitation.--

12(4) [The department shall waive the distance
13restrictions upon submission of a plan identifying additional
14measures, facilities or practices to be employed during well
15site construction, drilling and operations necessary to
16protect the waters of this Commonwealth. The waiver, if
1granted, shall include additional terms and conditions
2required by the department necessary to protect the waters of
3this Commonwealth. Notwithstanding section 3211(e), if a
4waiver request has been submitted, the department may extend
5its permit review period for up to 15 days upon notification
6to the applicant of the reasons for the extension.] The
7following shall apply:
8(i) No well may be drilled within the surface or
9subsurface area of, nor hydraulic fracturing or
10horizontal drilling conducted within 2,500 feet of, a
11water well, lake, reservoir, impoundment, spring or the
12permitted intake of a stream that serves as a primary
13source of supply for a community water system as defined
14in section 3 of the act of May 1, 1984 (P.L.206, No.43),
15known as the Pennsylvania Safe Drinking Water Act.
16(ii) The department may not waive the restrictions
17under this paragraph.

19Section 2. This act shall take effect in 60 days.
