AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for definitions; and providing
3for hydraulic fracturing waste transportation.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. The definition of "hazardous material" in section
7102 of Title 75 of the Pennsylvania Consolidated Statutes is
8amended and the section is amended by adding definitions to
9read:

10§ 102. Definitions.

11Subject to additional definitions contained in subsequent
12provisions of this title which are applicable to specific
13provisions of this title, the following words and phrases when
14used in this title shall have, unless the context clearly
15indicates otherwise, the meanings given to them in this section:

17"Drill cuttings." Rock cuttings and related mineral residues
18generated during the drilling of an oil or gas well.

2"Flowback." The return flow of water and formation fluids
3recovered from the wellbore of an unconventional well:

4(1) following the release of pressures induced as part
5of the hydraulic fracture stimulation of a target geologic
6formation; and

7(2) until the well is placed into production.

9"Hazardous material." Any explosive, blasting agent,
10flammable liquid, combustible liquid, flammable solid, flammable
11or nonflammable compressed gas, corrosive material, poison,
12poison gas, irritant, oxidizer, organic peroxide, radioactive
13material, etiologic agent, cryogenic liquid, hazardous waste,
14hydraulic fracturing waste, hazardous substance or other
15material which the department by procedure prescribed in Chapter
1683 (relating to hazardous materials transportation) declares to
17be a hazardous material.

19"Hydraulic fracturing waste." Any of the following:

20(1) Drilling mud.

21(2) Flowback.

22(3) Production brine.

23(4) Drill cuttings.

24(5) Any other drilling by-product generated at the well
25site.

27"Production brine." Water or formation fluids recovered at
28the wellhead of a producing unconventional well as a by-product
29of the production activity.

1Section 2. Title 75 is amended by adding a section to read:

2§ 8302.1. Hydraulic fracturing waste transportation.

3(a) Placard.--Any vehicle carrying hydraulic fracturing
4waste in this Commonwealth shall have a placard placed on the
5outside of the vehicle to show that the vehicle is carrying
6hydraulic fracturing waste.

7(b) Duties.--The department shall promulgate regulations
8concerning the design and placement of the placard described
9under subsection (a).

10Section 3. This act shall take effect in 60 days.
