AN ACT

 

1Amending Title 30 (Fish) of the Pennsylvania Consolidated
2Statutes, further providing for organization of commission.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 301(a) and (c) of Title 30 of the
6Pennsylvania Consolidated Statutes<-, amended November 1, 2012 
7(P.L.1716, No.211), are amended to read:

8§ 301. Organization of commission.

9(a) Composition.--The Pennsylvania Fish and Boat Commission
10is continued as an independent administrative commission and
11shall consist of ten competent citizens of this Commonwealth who
12shall be appointed by the Governor by and with the advice and
13consent of a majority of the members elected to the Senate <-[for
14terms of [eight<-] four years and until their successors are
15appointed and qualified<-].

17(c) Terms of office and compensation.--The members shall

1hold office for terms of [eight] four years [and<-] each and may 
2continue to hold office for a period of time not to exceed six 
3months or until a successor is appointed and qualified<-, 
4whichever occurs first. [A member appointed to fill a vacancy
5for a period of four years or less may be eligible for
6appointment to a full eight-year term.] A member who serves <-[a
7full eight-year term or fills a vacancy for a period of more
8than four years<-] three consecutive terms shall not be eligible
9for reappointment to the commission. <-[until a period of eight
10years expires.] The members shall receive no compensation for
11their services but may be reimbursed for travel expenses. When
12performing any function on behalf of the commission or acting
13within the scope of their official duties, members of the
14commission shall be authorized to operate Commonwealth vehicles
15and watercraft and shall be treated as employees of the
16Commonwealth for the purposes of automotive and general
17liability and the act of June 2, 1915 (P.L.736, No.338), known
18as the Workers' Compensation Act.

20Section 2. The <-following shall apply:

21(1) Except as provided under paragraph (2), the
22amendment of 30 Pa.C.S. § 301(a) and (c) shall apply to
23members of the Pennsylvania Fish and Boat Commission who are
24appointed on or after the effective date of this section.

<-25(2) Notwithstanding paragraph (1), a member of the
26Pennsylvania Fish and Boat Commission who serves a full
27eight-year term or fills a vacancy for a period of more than
28four years shall be eligible for reappointment to the
29commission at any time.

30Section 3. This act shall take effect in 60 days.
