AN ACT

 

1Amending Title 30 (Fish) of the Pennsylvania Consolidated
2Statutes, further providing for organization of commission.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 301(a) and (c) of Title 30 of the
6Pennsylvania Consolidated Statutes<-, amended November 1, 2012 
7(P.L.1716, No.211), are amended to read:

8§ 301. Organization of commission.

9(a) Composition.--The Pennsylvania Fish and Boat Commission
10is continued as an independent administrative commission and
11shall consist of ten competent citizens of this Commonwealth who
12shall be appointed by the Governor by and with the advice and
13consent of a majority of the members elected to the Senate for
14terms of [eight] four years and until their successors are
15appointed and qualified.

17(c) Terms of office and compensation.--The members shall

1hold office for terms of [eight] four years and until a
2successor is appointed and qualified. [A member appointed to
3fill a vacancy for a period of four years or less may be
4eligible for appointment to a full eight-year term.<-] A member
5who serves <-[a full eight-year term or fills a vacancy for a
6period of more than four years<-] three consecutive terms shall
7not be eligible for reappointment to the commission. <-[until a
8period of eight years expires.] The members shall receive no
9compensation for their services but may be reimbursed for travel
10expenses. When performing any function on behalf of the
11commission or acting within the scope of their official duties,
12members of the commission shall be authorized to operate
13Commonwealth vehicles and watercraft and shall be treated as
14employees of the Commonwealth for the purposes of automotive and
15general liability and the act of June 2, 1915 (P.L.736, No.338), 
16known as the Workers' Compensation Act.

18Section 2. The <-following shall apply:

19(1) Except as provided under paragraph (2), the
20amendment of 30 Pa.C.S. § 301(a) and (c) shall apply to
21members of the Pennsylvania Fish and Boat Commission who are
22appointed on or after the effective date of this section.

<-23(2) Notwithstanding paragraph (1), a member of the
24Pennsylvania Fish and Boat Commission who serves a full
25eight-year term or fills a vacancy for a period of more than
26four years shall be eligible for reappointment to the
27commission at any time.

28Section 3. This act shall take effect in 60 days.
