1Amending Title 30 (Fish) of the Pennsylvania Consolidated
2Statutes, further providing for organization of commission.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 301(a) and (c) of Title 30 of the
6Pennsylvania Consolidated Statutes, amended November 1, 2012 
7(P.L.1716, No.211), are amended to read:

8§ 301. Organization of commission.

9(a) Composition.--The Pennsylvania Fish and Boat Commission
10is continued as an independent administrative commission and
11shall consist of ten competent citizens of this Commonwealth who
12shall be appointed by the Governor by and with the advice and
13consent of a majority of the members elected to the Senate for
14terms of [eight] four years and until their successors are
15appointed and qualified.

17(c) Terms of office and compensation.--The members shall

1hold office for terms of [eight] four years and until a
2successor is appointed and qualified. [A member appointed to
3fill a vacancy for a period of four years or less may be
4eligible for appointment to a full eight-year term. A member who
5serves a full eight-year term or fills a vacancy for a period of
6more than four years shall not be eligible for reappointment to
7the commission until a period of eight years expires.] The
8members shall receive no compensation for their services but may
9be reimbursed for travel expenses. When performing any function
10on behalf of the commission or acting within the scope of their
11official duties, members of the commission shall be authorized
12to operate Commonwealth vehicles and watercraft and shall be
13treated as employees of the Commonwealth for the purposes of
14automotive and general liability and the act of June 2, 1915 
15(P.L.736, No.338), known as the Workers' Compensation Act.

<-17Section 2. The following shall apply:

18(1) Except as provided under paragraph (2), the
19amendment of 30 Pa.C.S. § 301(a) and (c) shall apply to
20members of the Pennsylvania Fish and Boat Commission who are
21appointed on or after the effective date of this section.

22(2) Notwithstanding paragraph (1), a member of the
23Pennsylvania Fish and Boat Commission who serves a full
24eight-year term or fills a vacancy for a period of more than
25four years shall be eligible for reappointment to the
26commission at any time.

27Section <-2 3. This act shall take effect in 60 days.
