1Amending the act of October 9, 2008 (P.L.1408, No.113), entitled
2"An act requiring scrap processors and recycling facility
3operators to collect certain information relating to the
4purchase of scrap material; requiring commercial accounts;
5and restricting scrap processors and recycling facility
6operators from purchasing certain materials," further
7providing for penalties.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 7 of the act of October 9, 2008
11(P.L.1408, No.113), known as the Scrap Material Theft Prevention
12Act, is amended to read:

13Section 7. Penalties.

14A scrap processor and recycling facility operator who
15violates this act commits a [summary offense and shall, upon
16conviction, be sentenced to pay a fine of up to $2,500]
17misdemeanor of the third degree and upon conviction shall be 
18sentenced to pay a fine of up to $5,000. A second or subsequent
19violation shall be classified as a misdemeanor of the [third]
20second degree and, upon conviction, the violator shall be 

1sentenced to pay a fine of up to $10,000.

2Section 2. This act shall take effect in 60 days.
