AN ACT

 

1Amending Title 25 (Elections) of the Pennsylvania Consolidated
2Statutes, further providing for SURE system, for 
3qualifications to register, for government agencies and for
4preparation and distribution of applications; providing for 
5nomination petitions; and making related repeals.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. Section 1222(c) of Title 25 of the Pennsylvania
9Consolidated Statutes is amended by adding paragraphs to read:

10§ 1222. SURE system.

12(c) Requirements.--The SURE system shall be developed as a
13single, uniform integrated computer system. All commissions
14shall be connected electronically to the SURE system and shall
15maintain their registration records in the system. The SURE
16system shall, at a minimum, do all of the following:

18(22) Allow individuals 17 years of age to register to

1vote.

2(23) In the district register for a primary, show
3eligible individuals 17 years of age who will turn 18 years
4of age before the general or municipal election.

5(24) In the district register:

6(i) provide a prompt for an election officer to lock
7voters 17 years of age out of referenda or special
8elections; and

9(ii) for counties with optical scan systems, provide
10a prompt to hand such voters a special ballot.

11(25) Operate so that individuals 17 years of age not
12registered and enrolled in a party are ineligible to vote in
13a primary election.

15Section 2. Section 1301(a) of Title 25 is amended and the
16section is amended by adding a subsection to read:

17§ 1301. Qualifications to register.

18(a) Eligibility.--[An] Except as otherwise provided for 
19under subsection (d), an individual who will be at least 18
20years of age on the day of the next election, who has been a
21citizen of the United States for at least one month prior to the
22next election and who has resided in this Commonwealth and the
23election district where the individual offers to vote for at
24least 30 days prior to the next ensuing election and has not
25been confined in a penal institution for a conviction of a
26felony within the last five years shall be eligible to register
27as provided in this chapter.

29(d) Eligibility for primaries.--An individual who meets the 
30requirements of subsection (a) who will be at least 18 years of 

1age on the day of the next general or municipal election may 
2register and vote for the corresponding primary for the purpose 
3of nominating candidates only, and not for voting on that 
4portion of the ballot involving a special election or 
5referendum. No person shall be entitled to vote as a member of a 
6party at any primary unless registered and enrolled as a member 
7of such party upon the district register. This enrollment upon 
8the district register shall be conclusive as to party membership 
9and shall not be subject to challenge on the day of the primary.

10Section 3. Sections 1325(b)(4) and 1327(a)(4)(iii) and (b)
11(1)(ii) and (iii) of Title 25 are amended to read:

12§ 1325. Government agencies.

14(b) Forms.--An agency designated in subsection (a) shall
15provide a form for office visits or, if the agency provides
16services to persons with disabilities, for home visits which
17contains all of the following:

19(4) The statement "In order to be qualified to register
20to vote, you must be at least 18 years of age on the day of
21the next general, municipal or special election or at least 
2217 years of age on the day of the next primary election, you
23must have been a citizen of the United States for at least
24one month prior to the next election and have resided in
25Pennsylvania and the election district where you plan to vote
26for at least 30 days prior to the next election, and you must
27not have been confined in a penal institution for a
28conviction of a felony within the last five years."

30§ 1327. Preparation and distribution of applications.

1(a) Form.--

3(4) A voter registration application shall be printed on
4stock of good quality and shall be of suitable uniform size.
5Nothing in this part shall prohibit the design and use of an
6electronic voter registration application which includes the
7applicant's digitized or electronic signature. The
8registration application shall contain the following
9information; however, the information may be provided on a
10separate form for voter registration made under section 1323
11or 1325:

13(iii) Notice that the applicant must be a citizen of
14the United States for at least one month prior to the
15next election and a resident of this Commonwealth and the
16election district for at least 30 days and must be at
17least 18 years of age by the day of the next [ensuing]
18general, municipal or special election or at least 17 
19years of age on the day of the next primary election, and
20has not been confined in a penal institution for a
21conviction of a felony within the last five years. The
22notice required in this subparagraph shall be in print
23identical to the declaration under subsection (b).

25(b) Registration declaration.--

26(1) The official voter registration application shall
27contain a registration declaration. On the declaration, the
28applicant shall state all of the following:

30(ii) On the day of the next [ensuing] general, 

1municipal or special election, the applicant shall be at
2least 18 years of age or on the day of the next primary 
3election, the applicant shall be at least 17 years of 
4age.

5(iii) On the day of the next [ensuing] general, 
6municipal, special or primary election, the applicant
7shall have resided in this Commonwealth and in the
8election district for at least 30 days.

10Section 4. Title 25 is amended by adding a section to read:

11§ 3303. Nomination petitions.

12Notwithstanding any other provision of law to the contrary, 
13an individual who satisfies the requirements of section 1301(d) 
14(relating to qualifications to register) shall be deemed a 
15registered and enrolled member of a party who is a qualified 
16elector of the State or of the political district for purposes 
17of signing or circulating a nomination petition under the act of 
18June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania 
19Election Code.

20Section 5. The Bureau of Commissions, Elections and
21Legislation shall promulgate regulations to carry out this act,
22particularly the addition of 25 Pa.C.S. § 1222(c)(22), (23),
23(24) and (25). Publication of the final-form regulations under
24this section shall take place within 20 months of the effective
25date of this section.

26Section 6. Repeals are as follows:

27(1) The General Assembly declares that the repeal under 
28paragraph (2) is necessary to effectuate the amendment or 
29addition of 25 Pa.C.S. §§ 1301(a) and (d), 1325(b)(4) and 
301327(a)(4)(iii) and (b)(1)(ii) and (iii).

1(2) Sections 701, 702, 703 and 704 of the act of June 3, 
21937 (P.L.1333, No.320), known as the Pennsylvania Election 
3Code, are repealed.

4Section 7. This act shall take effect as follows:

5(1) The following provisions shall take effect
6immediately:

7(i) Section 5 of this act.

8(ii) This section.

9(2) The remainder of this act shall take effect in 60
10days.
