AN ACT

 

1Amending Title 35 (Health and Safety) of the Pennsylvania
2Consolidated Statutes, authorizing the Pennsylvania Emergency
3Management Agency to pay rewards for information leading to
4the arrest and conviction of certain perpetrators; and
5establishing the Law Enforcement Line of Duty Death Reward
6Fund.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Chapter 73 of Title 35 of the Pennsylvania
10Consolidated Statutes is amended by adding a subchapter to read:

18§ 7391. Scope of subchapter.

19This subchapter authorizes the agency to offer and cause to

1be paid rewards for the arrest and conviction of perpetrators of
2an offense under 18 Pa.C.S. § 2507 (relating to criminal
3homicide of law enforcement officer) and establishes a fund from
4which to make reward payments.

5§ 7392. Definitions.

6The following words and phrases when used in this subchapter
7shall have the meanings given to them in this section unless the
8context clearly indicates otherwise:

9"Fund." The Law Enforcement Line of Duty Death Reward Fund
10established in section 7394 (relating to Law Enforcement Line of
11Duty Death Reward Fund).

12"Law enforcement officer." The term has the same meaning as
13the term "peace officer" as set forth in 18 Pa.C.S. § 501
14(relating to definitions).

15§ 7393. Agency authority.

16The agency is authorized to offer and cause to be paid
17rewards of up to $50,000 for information leading to the arrest
18and conviction of perpetrators of an offense under 18 Pa.C.S. §
192507 (relating to criminal homicide of law enforcement officer).

20§ 7394. Law Enforcement Line of Duty Death Reward Fund.

21(a) Establishment of fund.--The Law Enforcement Line of Duty
22Death Reward Fund is established as a special fund in the State
23Treasury.

24(b) Administration.--The fund shall be administered by the
25agency. The agency shall use moneys in the fund solely for the
26purpose of section 7393 (relating to agency authority).

27(c) Fund sources.--The sources of the fund are as follows:

28(1) Moneys transferred under subsection (d).

29(2) Contributions and donations to the fund.

30(d) Annual interfund transfers.--Commencing with fiscal year

12012-2013 and continuing annually thereafter, the sum of
2$750,000 shall be transferred from the State Gaming Fund to the
3Law Enforcement Line of Duty Death Reward Fund.

4Section 2. This act shall take effect in 60 days.
