AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in registration of vehicles, further providing for
3person with disability plate and placard.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1338(b) of Title 75 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 1338. Person with disability plate and placard.

10(b) Person with disability parking placard.--

11(1) A physician, podiatrist, chiropractor, physician
12assistant or certified registered nurse practitioner licensed
13or certified to practice in this Commonwealth or in a
14contiguous state who has determined that a person with a
15disability is disabled as provided in subsection (a) may
16issue a temporary special parking placard to the person. The
17temporary special parking placard shall be on a form approved

1by the department and shall be valid for a period of not more
2than 90 days.

3(2) On the initial application or renewal application of
4any person who meets the qualifications of subsection (a),
5the department shall issue one special parking placard of
6such size and design as the department shall specify,
7designating the vehicle in which it is displayed as being
8used for the transportation of persons with disabilities.

9(3) When parking the designated vehicle, the [person
10with] disability parking placard shall be prominently
11displayed in such a manner that it may be viewed from the
12front and rear of the vehicle by hanging it from the front
13windshield rearview mirror of a vehicle only when that
14vehicle is utilizing a parking space reserved for persons
15with disabilities. When there is no rearview mirror, or the
16placard is not designed in such a manner to accommodate
17hanging from a rearview mirror, the placard shall be
18displayed on the dashboard.

19(4) Placards may also be issued for use in vehicles when
20operated for the use and benefit of persons with disabilities
21provided that a person with a disability is being transported
22in the vehicle. Organizations that transport persons with
23disabilities shall upon application be issued not more than
24eight placards in the organization's name. These placards may
25be used in a vehicle of the organization or the personal
26vehicle of an employee or volunteer of the organization when
27the employee or volunteer operates the vehicle for the
28benefit and use of persons with disabilities provided that a
29person with a disability is being transported in the vehicle.
