AN ACT

 

1Amending the act of February 14, 2008 (P.L.6, No.3), entitled
2"An act providing for access to public information, for a
3designated open-records officer in each Commonwealth agency,
4local agency, judicial agency and legislative agency, for
5procedure, for appeal of agency determination, for judicial
6review and for the Office of Open Records; imposing
7penalties; providing for reporting by State-related
8institutions; requiring the posting of certain State contract
9information on the Internet; and making related repeals,"
10further providing for exceptions for public records.

11The General Assembly of the Commonwealth of Pennsylvania
12hereby enacts as follows:

13Section 1. Section 708(b)(6) of the act of February 14, 2008
14(P.L.6, No.3), known as the Right-to-Know Law, is amended to
15read:

18(b) Exceptions.--Except as provided in subsections (c) and
19(d), the following are exempt from access by a requester under
20this act:

1(6) (i) The following personal identification
2information:

3(A) A record containing all or part of a
4person's Social Security number, driver's license
5number, personal financial information, home,
6cellular or personal telephone numbers, personal e-
7mail addresses, employee number or other confidential
8personal identification number.

9(B) A spouse's name, marital status or
10beneficiary or dependent information.

11(C) The home address of a law enforcement
12officer [or], judge or any individual employed by a 
13public school district as defined in section 102 of 
14the act of March 10, 1949 (P.L.30, No.14), known as 
15the Public School Code of 1949.

16(ii) Nothing in this paragraph shall preclude the
17release of the name, position, salary, actual
18compensation or other payments or expenses, employment
19contract, employment-related contract or agreement and
20length of service of a public official or an agency
21employee.

22(iii) An agency may redact the name or other
23identifying information relating to an individual
24performing an undercover or covert law enforcement
25activity from a record.

27Section 2. This act shall take effect in 60 days.
