AN ACT

 

1Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2act to consolidate, editorially revise, and codify the public
3welfare laws of the Commonwealth," in departmental powers and
4duties as to licensing, further providing for definitions;
5and providing for child abuse recognition and reporting
6training.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1001 of the act of June 13, 1967 (P.L.31,
10No.21), known as the Public Welfare Code, is amended by adding
11definitions to read:

12Section 1001. Definitions.--As used in this article--

13"Abuse" means conduct that falls under the purview and
14reporting requirements of 23 Pa.C.S. Ch. 63 (relating to child
15protective services) and is directed toward or against a child
16under eighteen years of age.

18"Direct contact with children" means the possibility of care,
19supervision, guidance or control of children or routine
20interaction with children.

2Section 2. The act is amended by adding a section to read:

3Section 1022. Child Abuse Recognition and Reporting
4Training.--Within one hundred eighty days of the effective date
5of this section, the department shall adopt regulations to
6require that operators of child day care centers and employes
7who have direct contact with children receive child abuse
8recognition and reporting training. The following shall apply:

9(1) Operators shall receive three hours of training prior to
10the issuance of a license and three hours of training every five
11years thereafter.

12(2) Employes who have direct contact with children shall
13receive three hours of training within ninety days of the date
14of hire and three hours of training every five years thereafter.

15(3) Training programs shall be approved by the department,
16and shall address, but not be limited to:

17(i) Recognition of the signs of abuse and reporting
18requirements for suspected abuse in this Commonwealth.

19(ii) The child day care center's policies related to
20reporting of suspected abuse.

21Section 3. Section 1070 of the act is amended by adding
22definitions to read:

23Section 1070. Definitions.--As used in this article.--

24"Abuse" means conduct that falls under the purview and
25reporting requirements of 23 Pa.C.S. Ch. 63 (relating to child
26protective services) and is directed toward or against a child
27under eighteen years of age.

3Section 4. The act is amended by adding a section to read:

4Section 1076.1. Child Abuse Recognition and Reporting
5Training.--Within one hundred eighty days of the effective date
6of this section, the department shall adopt regulations to
7require that operators of family day care homes and employes who
8have direct contact with children receive child abuse
9recognition and reporting training. The following shall apply:

10(1) Operators shall receive three hours of training prior to
11the issuance of a registration certificate and three hours of
12training every five years thereafter.

13(2) Employes who have direct contact with children shall
14receive three hours of training within ninety days of the date
15of hire and three hours of training every five years thereafter.

16(3) Training programs shall be approved by the department,
17and shall address, but not be limited to, the recognition of the
18signs of abuse and reporting requirements for suspected abuse in
19this Commonwealth.

20Section 5. This act shall take effect in 60 days.
