AN ACT

 

1Amending the act of August 26, 1971 (P.L.351, No.91), entitled
2"An act providing for a State Lottery and administration
3thereof; authorizing the creation of a State Lottery
4Commission; prescribing its powers and duties; disposition of
5funds; violations and penalties therefor; exemption of prizes
6from State and local taxation and making an appropriation,"
7further providing for the Pharmaceutical Assistance Contract
8for the Elderly Needs Enhancement Tier.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. Section 519(b) of the act of August 26, 1971
12(P.L.351, No.91), known as the State Lottery Law, amended July
137, 2006 (P.L.1061, No.111), is amended to read:

17(b) PACENET eligibility.--[A]

18(1) Subject to annual adjustment under paragraph (2), a

1person with an annual income of not less than $14,500 and not
2more than $23,500 in the case of a single person and of not
3less than $17,700 and not more than $31,500 in the case of
4the combined income of persons married to each other shall be
5eligible for enhanced pharmaceutical assistance under this
6section. A person may, in reporting income to the department,
7round the amount of each source of income and the income
8total to the nearest whole dollar, whereby any amount which
9is less than 50¢ is eliminated.

10(2) Notwithstanding any other law, the minimum and
11maximum income levels under paragraph (1) shall be adjusted
12annually to reflect the maximum annual Social Security cost-
13of-living adjustment. Each year's adjustment shall be based
14on the prior year's minimum and maximum income levels. The
15adjustment required under this paragraph shall reflect
16calendar years 2009 and each calendar year thereafter.

18Section 2. This act shall be retroactive to January 1, 2008.

19Section 3. This act shall take effect immediately.
