AN ACT

 

1Amending the act of December 18, 2001 (P.L.949, No.114),
2entitled, as amended, "An act establishing a unified 
3workforce investment system; restructuring certain 
4administrative functions, procedures and entities; 
5transferring workforce development functions of Commonwealth 
6agencies; establishing the Pennsylvania Workforce Investment 
7Board; providing for critical job training grants, for 
8guarantees for program quality and performance for workforce 
9development programs, for workforce leadership grants and for 
10industry partnerships; establishing the Keystone Works 
11Program; and authorizing local workforce investment boards,"
12providing for allowance for veterans, guard members and
13military spouses.

14The General Assembly of the Commonwealth of Pennsylvania
15hereby enacts as follows:

16Section 1. The act of December 18, 2001 (P.L.949, No.114),
17known as the Workforce Development Act, is amended by adding a
18section to read:

19Section 1405.1. Allowance for veterans, guard members and
20military spouses.

21Notwithstanding the unemployment compensation benefits paid

1to qualified claimants under this act, each participating
2claimant in the program shall be paid a weekly allowance of not
3less than $50 for supportive services, including, but not
4limited to, transportation, child care and dependent care, that
5would enable the claimant to participate in the program. The
6following apply:

7(1) The allowance shall be paid out of the General Fund
8appropriation for the program or Federal funds that may be
9available for the purposes of this section.

10(2) Unless otherwise provided for by Federal law,
11payment of the allowance under this section may not be
12considered as income for the purposes of determining
13eligibility for and the amount of aid furnished under a
14federally assisted program based on need.

15(3) Payment of the allowance is limited to the following
16individuals:

17(i) a veteran of the United States Armed Forces who
18has been honorably discharged;

19(ii) a current or former member of the Pennsylvania
20National Guard who has been honorably discharged;

21(iii) a spouse of a veteran who has at least a 10%
22service-connected disability; or

23(iv) a spouse of a veteran who died while in service
24or from a service-connected disability who has not
25remarried since the veteran's death.

26(4) The allowance is not available to individuals
27eligible for the Veterans Retraining Assistance Program
28established in section 211 of the VOW to Hire Heroes Act of
292011 (Public Law 112-56, 125 Stat. 712).

30Section 2. This act shall take effect in 60 days.
