AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, in hunting and furtaking, further providing for
3penalties; and, in protection of property and persons,
4further providing for safety zones.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Sections 2364 and 2505(c) of Title 34 of the
8Pennsylvania Consolidated Statutes are amended to read:

9§ 2364. Penalties.

10Any violation of this subchapter relating to bobcat or otter
11is a summary offense of the fourth degree. Any violation of 
12section 2361(a)(11) (relating to unlawful acts concerning taking 
13of furbearers) is a summary offense of the first degree. Except
14for threatened or endangered species, any other violation of
15this subchapter is a summary offense of the fifth degree.

16§ 2505. Safety zones.

18(c) Definition.--As used in this section, the term "safety 
19zone" means:

1(1) Except as otherwise provided in [paragraph (2)]
2paragraphs (2) and (3), the area within 150 yards around and
3that area which is below the highest point of any occupied
4dwelling house, residence, or other building or camp occupied
5by human beings, or any barn, stable, or other building used
6in connection therewith or any attached or detached
7playground of any school, nursery school or day-care center.

8(2) When applied to properly licensed persons hunting
9with bow and arrow or crossbow and persons properly licensed 
10for falconry, the area within 50 yards around and that area
11which is below the highest point of any occupied dwelling
12house, residence or other building or camp occupied by human
13beings or any barn, stable or other building used in
14connection therewith and the area within 150 yards around and
15that area which is below the highest point of any attached or
16detached playground of any school, nursery school or day-care
17center.

18(3) When applied to properly licensed furtakers trapping
19within a permanent watercourse and using traps submerged in
20water, or making use of any special permit issued in
21accordance with this title or commission regulations, the
22area within 50 yards around any occupied dwelling house,
23residence or other building or camp occupied by human beings,
24or any barn, stable or other building used in connection
25therewith and the area within 150 yards around any attached
26or detached playground of any school, nursery school or day-
27care center.

28Section 2. This act shall take effect in 60 days.
