AN ACT

 

1Amending the act of December 19, 1990 (P.L.1200, No.202), 
2entitled "An act providing for the registration and 
3regulation of solicitations by charitable organizations, 
4professional fundraisers and other solicitors; imposing 
5additional powers on the Department of State and the Office 
6of Attorney General; prescribing civil and criminal 
7penalties; and making a repeal," further providing for 
8exemptions from registration.

9The General Assembly of the Commonwealth of Pennsylvania
10hereby enacts as follows:

11Section 1. Section 6(a)(3) of the act of December 19, 1990 
12(P.L.1200, No.202), known as the Solicitation of Funds for 
13Charitable Purposes Act, amended July 9, 1992 (P.L.436, No.92), 
14is amended to read:

15Section 6. Exemptions from registration.

16(a) General rule.--The following charitable organizations
17shall be exempt from the registration requirements of this act:

19(3) A local post, camp, chapter or similarly designated
20element or a county unit of such elements of:

1(i) any veterans' organization chartered under
2Federal law and any service foundation recognized in the
3bylaws of such organization;

4(ii) a bona fide organization of volunteer firemen;

5(iii) a bona fide ambulance association;

6(iv) a bona fide rescue squad association; or

7(v) a bona fide auxiliary or affiliate of any
8organization or association under subparagraph (i), (ii),
9(iii) or (iv);

<-10[provided that all fundraising activities of an organization
11or association under subparagraph (i), (ii), (iii), (iv) or
12(v) are carried on by volunteers, members or an auxiliary or
13affiliate thereof, and those volunteers, members or
14affiliates receive no compensation directly or indirectly for
15the fundraising activities.<-]

16provided that volunteers, members or an auxiliary or
17affiliate of an organization or association under
18subparagraph (i), (ii), (iii), (iv) or (v) receive no
19compensation directly or indirectly for carrying on
20organization or association fundraising activities and
21further provided that no fundraising activities of the
22organization or association be carried on by a professional
23solicitor. <-For the purpose of this paragraph, the term
24"fundraising activities" does not include any of the
25following:

26(i) Copying and printing camera-ready materials.

27(ii) Folding solicitations and inserting
28solicitations in envelopes.

29(iii) Addressing envelopes, including printing and
30affixing address labels.

1(iv) Mailing or delivering envelopes to a post
2office for mailing.

3(v) Using computer software to process mail and apply
4postal discounts or bar codes.

6Section 2. This act shall take effect immediately.
