AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for contraband.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1.  The heading of Subchapter B of Chapter 51 of
6Title 18 of the Pennsylvania Consolidated Statutes is amended to
7read:

8SUBCHAPTER B

9ESCAPE AND CONTRABAND

10Section 2.  Section 5123(c) of Title 18 is amended to read:

11§ 5123.  Contraband.

13(c)  Contraband other than controlled substance.--A person
14commits a misdemeanor of the first degree if he sells, gives or
15furnishes to any convict in a prison, or inmate in a mental
16hospital, or gives away in or brings into any prison, mental
17hospital, or any building appurtenant thereto, or on the land

1granted to or owned or leased by the Commonwealth or county for
2the use and benefit of the prisoners or inmates, or puts in any
3place where it may be secured by a convict of a prison, inmate
4of a mental hospital, or employee thereof, any of the following:

5(1)  Any kind of spirituous or fermented liquor, medicine
6or poison (except the ordinary hospital supply of the prison
7or mental hospital) without a written permit signed by the
8physician of such institution, specifying the quantity and
9quality of the substance which may be furnished to any
10convict, inmate or employee in the prison or mental hospital,
11the name of the prisoner, inmate or employee for whom, and
12the time when the same may be furnished, which permit shall
13be delivered to and kept by the warden or superintendent of
14the prison or mental hospital.

15(2)  Any item designated by the Secretary of Corrections
16or the facility manager as a prohibited item.

18Section 3.  This act shall take effect in 60 days.
