1Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2act to consolidate, editorially revise, and codify the public
3welfare laws of the Commonwealth," in departmental powers and
4duties as to licensing, further providing for definitions and
5for regulations.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1.  Section 1001 of the act of June 13, 1967 (P.L.31,
9No.21), known as the Public Welfare Code, is amended by adding
10definitions to read:

11Section 1001.  Definitions.--As used in this article--

13"Child development student" means a student of a Pennsylvania
14vocational-technical school who is:

15(1)  at least thirteen years of age; and

16(2)  enrolled in an early childhood education program and
17under the supervision of a program instructor or a child-care
18staff member.

1"Early childhood education program" means a course of study,
2approved by the Department of Education, at a Pennsylvania
3vocational-technical school that is intended to prepare students
4for careers or postsecondary education in child care or early
5childhood education.

7Section 2.  Section 1021 of the act is amended by adding a
8subsection to read:

9Section 1021.  Regulations.--* * *

10(e)  Within one hundred eighty days of the effective date of
11this subsection, the department shall adopt regulations that
12allow child development students to serve as volunteers in child
13day care centers. The following apply:

14(1)  a child development student volunteering in a child day
15care center must be supervised by a program instructor or a
16child-care staff member at all times;

17(2)  a child development student must be at least five years
18older than any child receiving care at the child day care center
19where they are serving as a volunteer;

20(3)  serving as a volunteer in a child day care center must
21be a requirement of the early childhood education program in
22which the child development student is enrolled; and

23(4)  a child development student serving as a volunteer in a
24child day care center may not receive remuneration for his
25service.

26Section 3.  This act shall take effect in 60 days.
