AN ACT

 

1Amending the act of December 17, 1968 (P.L.1224, No.387),
2entitled "An act prohibiting unfair methods of competition
3and unfair or deceptive acts or practices in the conduct of
4any trade or commerce, giving the Attorney General and
5District Attorneys certain powers and duties and providing
6penalties," further providing for the definition of "unfair
7methods of competition."

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1.  Section 2(4) of the act of December 17, 1968
11(P.L.1224, No.387), known as the Unfair Trade Practices and
12Consumer Protection Law, reenacted and amended November 24, 1976
13(P.L.1166, No.260) and amended December 4, 1996 (P.L.906,
14No.146), is amended by adding a subclause to read:

15Section 2.  Definitions.--As used in this act.

17(4)  "Unfair methods of competition" and "unfair or deceptive
18acts or practices" mean any one or more of the following:

20(xxii)  Failing to provide an individual who signed a

1contract for direct-to-home satellite transmission service with
2written notice containing the terms and conditions of service
3and a complete listing of the viewing channels and any
4additional features included in the subscription package or
5service provided for in the contract. The viewing channels and
6additional features listed in the notice shall be specific to
7the subscribed to service package. The notice shall provide an
8affirmation, signed by the contracting individual, verifying
9that the individual received the notice and a copy shall be
10provided to the individual. For purposes of this subclause,
11"direct-to-home satellite transmission service" shall include
12transmission, distribution and broadcasting of video programming
13or services by satellite directly to the service address of the
14individual subscribing to the programming or services without
15use of ground receiving or distribution equipment, except at the
16service address or in an uplink process to the satellite.

17Section 2.  This act shall take effect in 60 days.
