AN ACT

 

1Amending Title 35 (Health and Safety) of the Pennsylvania
2Consolidated Statutes, providing for emergency service system
3billing.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 8103 of Title 35 of the Pennsylvania
7Consolidated Statutes is amended by adding a definition to read:

8§ 8103.  Definitions.

9The following words and phrases when used in this chapter
10shall have the meanings given to them in this section unless the
11context clearly indicates otherwise:

13"Insurer."  As follows:

14(1)  An entity that is responsible for providing or 
15paying for all or part of the cost of emergency medical 
16services covered by an insurance policy, contract or plan. 

1The term includes an entity subject to:

2(i)  the act of May 17, 1921 (P.L.682, No.284), known 
3as The Insurance Company Law of 1921;

4(ii)  the act of December 29, 1972 (P.L.1701, 
5No.364), known as the Health Maintenance Organization 
6Act; or

7(iii)  40 Pa.C.S. Ch. 61 (relating to hospital plan 
8corporations) or 63 (relating to professional health 
9services plan corporations).

10(2)  The term does not include an entity that is
11responsible for providing or paying under an insurance
12policy, contract or plan which meets any of the following:

13(i)  Is a homeowner's insurance policy.

14(ii)  Provides any of the following types of
15insurance:

16(A)  Accident only.

17(B)  Fixed indemnity.

18(C)  Limited benefit.

19(D)  Credit.

20(E)  Dental.

21(F)  Vision.

22(G)  Specified disease.

23(H)  Medicare supplement.

24(I)  Civilian Health and Medical Program of the
25Uniformed Services (CHAMPUS) supplement.

26(J)  Long-term care.

27(K)  Disability income.

28(L)  Workers' compensation.

29(M)  Automobile medical payment insurance.

1Section 2.  Title 35 is amended by adding a section to read:

2§ 8158.  Billing.

3(a)  General rule.--When an emergency medical services agency
4is properly dispatched by a public safety answering point as
5defined in section 5302 (relating to definitions) and provides
6medically necessary emergency care, a payment made by an insurer
7for a claim covered under a health insurance policy for a
8service performed by the emergency medical services agency
9during the call shall be paid directly to the emergency medical
10services agency.

11(b)  Application.--This section shall be construed to apply
12only to emergency medical services agencies that are nonnetwork
13providers.

14Section 3.  This act shall take effect in 60 days.
