AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for DARE plate and for payments
3to special funds.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 1358 of Title 75 of the Pennsylvania
7Consolidated Statutes is repealed:

8[§ 1358.  DARE plate.

9The department, in consultation with the Pennsylvania
10Commission on Crime and Delinquency, shall design a special drug
11abuse resistance education (DARE) registration plate which
12utilizes the DARE logo or slogan in the design. Upon application
13of any person, accompanied by a fee of $35 which shall be in
14addition to the annual registration fee, the department shall
15issue the plate for a passenger car, motor home, trailer or
16truck with a registered gross weight of not more than 10,000
17pounds. The Drug Abuse Resistance Education Program shall

1receive $15 of each additional fee for this plate.]

2Section 2.  Section 1905(c) of Title 75 is amended to read:

3§ 1905.  Payments to special funds.

5(c)  Drug Abuse Resistance Education Fund.--[Fifteen dollars
6of each fee received under section 1358 (relating to DARE plate)
7shall be credited to the Drug Abuse Resistance Education Fund,
8established as follows:

9(1)  There is hereby established a special account in the
10State Treasury which shall be known as the Drug Abuse
11Resistance Education (DARE) Fund. The purpose of the DARE
12Fund is to provide moneys for an ongoing educational program
13in public schools to prevent drug abuse, utilizing police
14agency representatives, school district employees, materials,
15supplies and other necessary expenses associated with the
16program.

17(2)  All moneys in the DARE Fund are hereby annually
18appropriated to the Pennsylvania Commission on Crime and
19Delinquency and may be expended for the purposes authorized
20under this subsection.] The following shall apply:

21(1)  The Drug Abuse Resistance Education (DARE) Fund
22shall terminate at the end of the 2013-2014 fiscal year.

23(2)  All money in the Drug Abuse Resistance Education 
24(DARE) Fund on the effective date of this paragraph shall be 
25appropriated to the Pennsylvania Commission on Crime and 
26Delinquency and shall be expended to provide grants to 
27organizations and nonprofit entities employing a 
28multidisciplinary approach to the prevention, identification, 
29investigation, prosecution and treatment of child abuse, 
30including Children's Advocacy Centers, during fiscal year 

12013-2014. All money in the the Drug Abuse Resistance 
2Education (DARE) Fund on the date of termination shall be 
3transferred to the General Fund.

4(3)  Estimates of amounts to be expended under this
5subsection shall be submitted to the Governor by the
6Pennsylvania Commission on Crime and Delinquency for his
7approval.

8(4)  The State Treasurer shall not honor any requisition
9for expenditures by the Pennsylvania Commission on Crime and
10Delinquency in excess of estimates approved by the Governor
11or in excess of the amount available for the purposes for
12which the requisition was made, whichever is the lesser
13amount.

14Section 3.  This act shall take effect in 60 days.
