AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for the offense of
3harassment.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

<-6Section 1. Section 2709(c) of Title 18 of the Pennsylvania
7Consolidated Statutes is amended to read:

10§ 2709. Harassment.

12(c) Grading.--

13[(1) An offense under subsection (a)(1), (2) or (3)
14shall constitute a summary offense.

15(2) (i) An offense under subsection (a)(4), (5), (6) or
16(7) shall constitute a misdemeanor of the third degree.]

1(1) Except as provided under paragraph (3), an offense
2under subsection (a)(1), (2) or (3) shall constitute a
3summary offense.

4(2) An offense under subsection (a)(4), (5), (6) or (7)
5shall constitute a misdemeanor of the third degree.

6(3) The grading of an offense under subsection (a)(1)
7or, (2) or (3) shall be enhanced one degree if the person <-is
8in violation of an order issued under 23 Pa.C.S. § 6108
9(relating to relief). <-has previously violated an order issued
10under 23 Pa.C.S. § 6108 (relating to relief) involving the
11same victim, family or household member.

<-13(f) Definitions.--As used in this section, the following
14words and phrases shall have the meanings given to them in this
15subsection:

17"Family or household member." Spouses or persons who have
18been spouses, persons living as spouses or who lived as spouses,
19parents and children, other persons related by consanguinity or
20affinity, current or former sexual or intimate partners or
21persons who share biological parenthood.

22Section 2. This act shall take effect in 60 days.
