AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for fees; providing for penalties
3for violations of traffic-control devices; and further
4providing for surcharges and for the definition and
5determination of "average wholesale price."

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1.  Sections 1553(c), 1554(c) and 1617(1), (2) and
9(4) of Title 75 of the Pennsylvania Consolidated Statutes are
10amended to read:

11§ 1553.  Occupational limited license.

13(c)  Fee.--The fee for applying for an occupational limited
14license shall be [$50] $59. This fee shall be nonrefundable and
15no other fee shall be required.

17§ 1554.  Probationary license.

19(c)  Fee.--The fee for applying for a probationary license

1shall be [$25] $29.50. The fee shall be nonrefundable. The
2annual fee for issuance of a probationary license shall be [$50]
3$59, plus the cost of the photograph required in section 1510(a)
4(relating to issuance and content of driver's license), which
5shall be in addition to all other licensing fees.

7§ 1617.  Fees.

8Fees relating to commercial drivers' licenses to be collected
9by the department under this chapter shall be in addition to any
10other fees imposed under the provisions of this title and are as
11follows:

12(1)  The annual fee for a commercial driver's license
13designation shall be [$10] $17.

14(2)  In addition to any other restoration fee required by
15this title, an additional restoration fee of [$50] $86 shall
16be assessed and collected before reinstating a commercial
17driver's operating privilege following a suspension or
18revocation under this title or disqualification under this
19chapter.

21(4)  An additional fee of [$10] $17 shall be imposed for
22the initial issuance or renewal of a commercial driver's
23license with an "H" or "X" endorsement, in addition to the
24cost of a criminal history background check as required by
25the USA Patriot Act of 2001 (Public Law 107-56, 115 Stat.
26272).

27Section 2.  Title 75 is amended by adding a section to read:

28§ 1906.  Annual adjustment.

29Unless otherwise indicated, the fees listed in Subchapters B
30(relating to registration fees) and D (relating to miscellaneous

1fees) shall be the amount established in the previous year
2increased 3% and rounded up to the nearest dollar.

3Section 3.  Sections 1911(a), 1912, 1913, 1914, 1915, 1916(a)
4(1), 1917, 1918, 1920(a) and (c), 1921, 1923, 1925, 1926(a), (b)
5and (c), 1927, 1928, 1929, 1930, 1931, 1931.1, 1932, 1951,
61952(a), 1953, 1955(a), 1956(a), 1958(a), 1959 and 1960 of Title
775 are amended to read:

8§ 1911.  Annual registration fees.

9(a)  General rule.--[An] Twice the annual fee for the
10registration of vehicles as provided in Chapter 13 (relating to
11the registration of vehicles) shall be charged by the department
12as provided in this title.

14§ 1912.  Passenger cars.

15The annual fee for registration of a passenger car shall be
16[$36] $49.

17§ 1913.  Motor homes.

18The annual fee for registration of a motor home shall be
19determined by its registered gross weight in pounds according to
20the following table:

26§ 1914.  Motorcycles.

2§ 1916.  Trucks and truck tractors.

3(a)  General rule.--

4(1)  The annual fee for registration of a truck or truck
5tractor shall be determined by its registered gross weight or
6combination weight in pounds according to the following

18§ 1918.  School buses and school vehicles.

19The annual fee for registration of a school bus or school

21§ 1920.  Trailers.

22(a)  General rule.--The annual fee for registration of a
23trailer shall be determined by its registered gross weight
24according to the following table:

1(c)  Optional permanent registration.--A trailer with a
2registered gross weight of 10,001 or more pounds may be
3registered for a one-time fee of [$135] $340 in lieu of the
4annual fee at the option of the registrant.

5§ 1921.  Special mobile equipment.

6The annual fee for registration of special mobile equipment
7shall be [$36] $49.

8§ 1923.  Antique, classic and collectible vehicles.

9The fee for registration of an antique, classic or
10collectible motor vehicle shall be [$75] $101.

11§ 1925.  Ambulances, taxis and hearses.

12The annual fee for registration of an ambulance, taxi or
13hearse shall be [$54] $72.

14§ 1926.  Dealers and miscellaneous motor vehicle business.

15(a)  General rule.--The annual fee for a dealer registration
16plate or miscellaneous motor vehicle business plate shall be
17[$36] $49.

18(b)  Motorcycle dealers.--The annual fee for each dealer
19registration plate issued to a motorcycle dealer other than a
20motor-driven cycle dealer shall be [$18] $24.

21(c)  Motor-driven cycle dealers.--The annual fee for each
22dealer registration plate issued to a motor-driven cycle dealer
23shall be [$9] $12.

25§ 1927.  Transfer of registration.

26The fee for transfer of registration shall be [$6] $8.

27§ 1928.  Temporary and electronically issued registration
28plates.

29The fee payable by a dealer or other dispensing agent for a
30temporary registration plate or for a registration plate to be

1issued for new registration processed electronically with the
2department shall be [$5] $13. The charge of the agent for
3providing an applicant with a plate under this section shall not
4exceed a total of [$10] $18.

5§ 1929.  Replacement registration plates.

6The fee for a replacement registration plate other than a
7legislative or personal plate shall be [$7.50] $10.

8§ 1930.  Legislative registration plates.

9The fee for issuance of a legislative registration plate
10shall be [$20] $27 which shall be in addition to the annual
11registration fee. Only one payment of the issuance fee shall be
12charged for each legislative registration plate issued or
13replaced.

14§ 1931.  Personal registration plates.

15The fee for issuance of a personal registration plate shall
16be [$20] $30 which shall be in addition to the annual
17registration fee. Only one payment of the issuance fee shall be
18charged for each personal registration issued or replaced.

19§ 1931.1.  Street rod registration plates.

20The fee for the issuance of a street rod registration plate
21shall be [$20] $27 which shall be in addition to the annual
22registration fee. Only one payment of the issuance fee shall be
23charged for each street rod registration plate issued or
24replaced.

25§ 1932.  Duplicate registration cards.

26The fee for each duplicate registration card when ordered at
27the time of vehicle registration, the transfer or renewal of
28registration or the replacement of a registration plate shall be
29[$1.50] $2. The fee for each duplicate registration card issued
30at any other time shall be [$4.50] $6.

1§ 1951.  Driver's license and learner's permit.

2(a)  Driver's license.--The driver's license fee for each
3year or partial year shall be [$5.25] $6.25 plus the cost of the
4photograph required in section 1510(a) (relating to issuance and
5content of driver's license).

6(b)  Learner's permit.--The fee for a learner's permit shall
7be [$5] $17.

8(c)  Identification card.--The [fee for an identification
9card shall be $5] identification card fee for each year or 
10partial year shall be $6.25 plus the cost of the photograph.

11(d)  Replacement license or card.--The fee for a replacement
12driver's license or identification card shall be [$5] $7 plus
13the cost of the photograph.

14(e)  Driver examination fee.--The department is authorized to
15charge a reasonable fee for administering a driver skill test.

16§ 1952.  Certificate of title.

17(a)  General rule.--The fee for issuance of a certificate of
18title shall be [$22.50] $30.

20§ 1953.  Security interest.

21The fee for recording or changing the amount of security
22interest on a certificate of title shall be [$5] $13.

23§ 1955.  Information concerning drivers and vehicles.

24(a)  Drivers, registrations, titles and security interests.--
25The fee for a copy of written or electronic information relating
26to a driver, registration, title or security interest shall be
27[$5] $17.

29§ 1956.  Certified copies of records.

30(a)  Department records.--The fee for a certified copy of any

1department record which the department is authorized by law to
2furnish to the public shall be [$5] $35 for each form or
3supporting document comprising such record.

5§ 1958.  Certificate of inspection.

6(a)  General rule.--The department shall charge [$2] $3 for
7each annual certificate of inspection [and $1], $3 for each
8semiannual certificate of inspection and $3 for each certificate 
9of exemption.

11§ 1959.  Messenger service.

12(a)  Annual registration.--The annual fee for registration of
13a messenger service as provided for in Chapter 75 (relating to
14messenger service) shall be [$50] $172.

15(b)  Additional places of business.--The annual fee for
16registration of additional place of business or branch office
17from which a messenger service may transact business shall be
18[$25] $86.

19(c)  Transfer of location.--The fee for the transfer of
20location of a registered place of business or branch office of a
21messenger service during a period of registration shall be [$5]
22$17.

23§ 1960.  Reinstatement of operating privilege or vehicle
24registration.

25The department shall charge a fee of [$25] $68 or, if section
261379 (relating to suspension of registration upon sixth unpaid
27parking violation in cities of the first class) or 1786(d)
28(relating to required financial responsibility) applies, a fee
29of [$50] $86 to restore a person's operating privilege or the
30registration of a vehicle following a suspension or revocation.

1Section 4.  Section 3111 of Title 75 is amended by adding a
2subsection to read:

3§ 3111.  Obedience to traffic-control devices.

5(e)  Penalty.--Any person who violates this section commits a
6summary offense and, upon conviction, shall be sentenced to pay
7a fine of $75.

8Section 5.  Section 6506(a) of Title 75 is amended by adding
9a paragraph and the section is amended by adding a subsection to
10read:

11§ 6506.  Surcharge.

12(a)  Levy and imposition.--In addition to any fines, fees or
13penalties levied or imposed as provided by law, under this title
14or any other statute, a surcharge shall be levied for
15disposition in accordance with subsection (b) as follows:

17(10)  In addition to any other surcharge imposed under
18this section, upon conviction for any violation of Chapter 15
19(relating to licensing of drivers), 16 (relating to
20commercial drivers), 17 (relating to financial
21responsibility), 31 (relating to general provisions), 37
22(relating to miscellaneous provisions) or 38 (relating to
23driving after imbibing alcohol or utilizing drugs), a
24surcharge of $100.

25The provisions of this subsection shall not apply to any
26violation committed by the operator of a motorcycle, motor-
27driven cycle, pedalcycle, motorized pedalcycle or recreational
28vehicle not intended for highway use.

29(a.1)  Deposit of surcharges.--The surcharges levied and
30collected under subsection (a)(10) shall be deposited into the

2Section 6.  The definition of "average wholesale price" in
3section 9002 of Title 75 is amended to read:

4§ 9002.  Definitions.

5The following words and phrases when used in this chapter
6shall have the meanings given to them in this section unless the
7context clearly indicates otherwise:

9"Average wholesale price."  The average wholesale price per
10gallon of all taxable liquid fuels and fuels, excluding the
11Federal excise tax and all liquid fuels taxes, as determined [by
12the Department of Revenue for the 12-month period ending on the
13September 30 immediately prior to January 1 of the year for
14which the rate is to be set. In no case shall the average
15wholesale price be less than 90¢ nor more than $1.25 per gallon]
16under section 9002.1 (relating to average wholesale price).

18Section 7.  Title 75 is amended by adding a section to read:

19§ 9002.1.  Average wholesale price.

20(a)  Legislative determination.--The average wholesale price 
21for the following fiscal years shall be as follows:

22(1)  For fiscal year 2012-2013, $1.54 per gallon.

23(2)  For fiscal year 2013-2014, $1.83 per gallon.

24(3)  For fiscal year 2014-2015, $2.12 per gallon.

25(4)  For fiscal year 2015-2016, $2.41 per gallon.

26(b)  Administrative determination.--For fiscal years
27beginning after June 30, 2016, the department shall determine
28the average wholesale price as follows:

29(1)  The minimum average wholesale price shall be $2.70
30per gallon.

1(2)  There shall be no maximum average wholesale price.

2Section 8.  This act shall take effect immediately.
