| A RESOLUTION |
| |
1 | Honoring Irwin "Sonny" Popowsky for his 33 years of public |
2 | service in the Office of Consumer Advocate. |
3 | WHEREAS, The Office of Consumer Advocate is charged with the |
4 | representation of utility consumers in matters before the Public |
5 | Utility Commission and other Federal and State commissions and |
6 | courts; and |
7 | WHEREAS, The Consumer Advocate is nominated by the Attorney |
8 | General and confirmed by the State Senate; and |
9 | WHEREAS, Irwin "Sonny" Popowsky joined Pennsylvania's Office |
10 | of Consumer Advocate in 1979 as an assistant consumer advocate; |
11 | and |
12 | WHEREAS, In 1990, Mr. Popowsky was appointed Pennsylvania's |
13 | Consumer Advocate; and |
14 | WHEREAS, Mr. Popowsky has participated in the drafting of |
15 | many major legislative measures such as telephone restructuring, |

1 | electric consumer choice and natural gas restructuring; and |
2 | WHEREAS, Mr. Popowsky was President of the National |
3 | Association of State Utility Consumer Advocates from 1996 to |
4 | 1998; and |
5 | WHEREAS, Mr. Popowsky has served on numerous national and |
6 | State boards, such as the Board of Trustees of the North |
7 | American Electric Reliability Council, the Board of Directors of |
8 | the North American Electric Reliability Council, the Board of |
9 | Directors of the North American Energy Standards Board and the |
10 | Keystone Energy Board; and |
11 | WHEREAS, In 2010, Mr. Popowsky was appointed by the Secretary |
12 | of Energy to the Department of Energy Electricity Advisory |
13 | Committee; and |
14 | WHEREAS, Mr. Popowsky was selected to serve on the |
15 | Stakeholder Steering Committee of the Department of Energy- |
16 | sponsored Eastern Interconnection Planning Collaborative; and |
17 | WHEREAS, In 1988, Mr. Popowsky briefed and argued the |
18 | landmark United States Supreme Court case of Duquesne Light |
19 | Company v. Barasch, in which the court upheld the position of |
20 | the Office of Consumer Advocate that two Pennsylvania utilities |
21 | had no constitutional right to charge consumers for the costs of |
22 | four canceled nuclear power plants; and |
23 | WHEREAS, Mr. Popowsky has a nationally recognized |
24 | understanding of public utility regulation; and |
25 | WHEREAS, Mr. Popowsky has always considered his service to |
26 | Pennsylvania utility consumers as an honor and a privilege; and |
27 | WHEREAS, Mr. Popowsky has advocated for the rights and |
28 | protections of utility consumers, and treated opposing opinions |
29 | with respect; and |
30 | WHEREAS, The Senate recognizes Mr. Popowsky's service in the |

1 | regulatory community; and |
2 | WHEREAS, Mr. Popowsky's kind and caring leadership and |
3 | tireless pursuit of the common good have inspired a new |
4 | generation of young attorneys to specialize in the practice of |
5 | public utility law; and |
6 | WHEREAS, Mr. Popowsky's abilities will be deeply missed by |
7 | colleagues and the public at large; therefore be it |
8 | RESOLVED, That the Senate honor Irwin "Sonny" Popowsky for |
9 | his 33 years of public service in the Office of Consumer |
10 | Advocate and wish him well in his retirement. |
