AN ACT

Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated

Statutes, in unconventional gas well fee, further providing

3

for distribution of fee.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 2314(c.1) of Title 58 of the Pennsylvania

7

Consolidated Statutes, added February 14, 2012 (P.L.87, No.13),

8

is amended by adding a paragraph to read:

§ 2314.  Distribution of fee.

(c.1)  Additional distributions.--From fees collected under

12

this chapter and deposited in the fund for 2011 and each year

13

thereafter:

(7)  Two million dollars to the Department of Health for

16

the establishment of a population-based health registry. The

17

registry shall be used to assess and evaluate the potential

18

adverse health consequences associated with the drilling of

unconventional wells in this Commonwealth. To establish the

2

registry, the Department of Health may partner or contract

3

with other entities. Information in the registry shall be

4

available to attending physicians on a 24-hour basis,

5

including access by electronic means. Personal health

6

information in the registry shall be protected from public

7

access and shall only be accessible to physicians and shall

8

not be subject to access under the act of February 14, 2008

9

(P.L.6, No.3), known as the Right-to-Know Law.

Section 2.  This act shall take effect in 60 days.
