| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in pupils and attendance, further |
6 | providing for cost of tuition and maintenance of certain |
7 | exceptional children in approved institutions and for actual |
8 | cost of tuition and maintenance of certain exceptional |
9 | children in the four chartered schools for education of the |
10 | deaf and the blind. |
11 | The General Assembly of the Commonwealth of Pennsylvania |
12 | hereby enacts as follows: |
13 | Section 1. Sections 1376(a.2)(1) and 1376.1(b.2)(1) of the |
14 | act of March 10, 1949 (P.L.30, No.14), known as the Public |
15 | School Code of 1949, amended July 4, 2004 (P.L.536, No.70), are |
16 | amended to read: |
17 | Section 1376. Cost of Tuition and Maintenance of Certain |
18 | Exceptional Children in Approved Institutions.--* * * |
19 | (a.2) For the 2005-2006 school year and each school year |
20 | thereafter, the Department of Education shall determine the |
21 | payment amount for each approved private school for all students |

1 | enrolled in an approved private school for the prior school year |
2 | as follows: |
3 | (1) (i) Multiply the payment determined for the immediate |
4 | preceding school year by one hundred and twenty-five percent |
5 | (125%) of the percentage increase in the appropriation for |
6 | special education for the fiscal year prior to the fiscal year |
7 | in which payments under this subsection are made. |
8 | (ii) Add the product from subparagraph (i) to the payment |
9 | determined for the immediate preceding school year. |
10 | (iii) In any fiscal year in which there is no increase in |
11 | the State appropriation for special education, the increase for |
12 | the approved private schools in any following fiscal year shall |
13 | be calculated by applying the multiplier in subparagraph (i) to |
14 | the percentage increase in the appropriation of the approved |
15 | private schools from the last fiscal year in which there was an |
16 | increase in the approved private schools' State appropriations. |

18 | Section 1376.1. Actual Cost of Tuition and Maintenance of |
19 | Certain Exceptional Children in the Four Chartered Schools for |
20 | Education of the Deaf and the Blind.--* * * |
21 | (b.2) Payments are as follows: |
22 | (1) For the 2005-2006 school year and each school year |
23 | thereafter, the department shall determine the payment amount |
24 | for each chartered school for all students enrolled in a |
25 | chartered school for the prior school year as follows: |
26 | (i) Multiply the payment determined for the immediate |
27 | preceding school year by one hundred and twenty-five percent |
28 | (125%) of the percentage increase in the appropriation for |
29 | special education for the fiscal year prior to the fiscal year |
30 | in which payments under this subsection are made. |
