AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in preliminary provisions, further

6

providing for definitions; prohibiting certain action

7

affecting Keystone Exams; and, in the State Board of

8

Education, further providing for powers and duties of the

9

board.

The General Assembly of the Commonwealth of Pennsylvania

11

hereby enacts as follows:

Section 1.  Section 102 of the act of March 10, 1949 (P.L.30,

13

No.14), known as the Public School Code of 1949, is amended by

14

adding a definition to read:

Section 102.  Definitions.--When used in this act the

16

following words and phrases shall have the following meanings:

"Keystone Exam."  An assessment developed or caused to be

19

developed by the Department of Education pursuant to 22 Pa. Code

20

§ 4.51(f) (relating to State assessment system).

Section 2.  The act is amended by adding a section to read:

Section 120.  Prohibition of Certain Actions Affecting

2

Keystone Exams.--Notwithstanding any provision of law to the

3

contrary, the Department of Education shall take no action prior

4

to June 30, 2020, that has the effect of eliminating, limiting

5

or delaying the development or implementation of Keystone Exams.

Section 3.  Section 2603-B of the act is amended by adding a

7

subsection to read:

Section 2603-B.  Powers and Duties of the Board.--* * *

(l)  (i)  Notwithstanding any provision of law to the

10

contrary, the board shall make no rule or regulation and shall

11

adopt no statement of policy, standard or principle that has the

12

effect of eliminating, limiting or delaying the development or

13

implementation of Keystone Exams by the Department of Education

14

pursuant to 22 Pa. Code § 4.51 (relating to State assessment

15

system).

(ii)  This subsection shall expire June 30, 2020.

Section 4.  This act shall take effect immediately.
