AN ACT

Amending the act of November 30, 2004 (P.L.1672, No.213),

2

entitled "An act providing for the sale of electric energy

3

generated from renewable and environmentally beneficial

4

sources, for the acquisition of electric energy generated

5

from renewable and environmentally beneficial sources by

6

electric distribution and supply companies and for the powers

7

and duties of the Pennsylvania Public Utility Commission," 

8

further providing for definitions.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

Section 1.  The definitions of "customer-generator" and "net

12

metering" in section 2 of the act of November 30, 2004

13

(P.L.1672, No.213), known as the Alternative Energy Portfolio

14

Standards Act, amended July 17, 2007 (P.L.114, No.35), are

15

amended to read:

Section 2.  Definitions.

The following words and phrases when used in this act shall

18

have the meanings given to them in this section unless the

19

context clearly indicates otherwise:

"Customer-generator."  A nonutility owner [or], operator or

lessee of a net metered distributed generation system with a

2

nameplate capacity of not greater than 50 kilowatts if installed

3

at a residential service or not larger than 3,000 kilowatts at

4

other customer service locations, except for customers whose

5

systems are above three megawatts and up to five megawatts who

6

make their systems available to operate in parallel with the

7

electric utility during grid emergencies as defined by the

8

regional transmission organization or where a microgrid is in

9

place for the primary or secondary purpose of maintaining

10

critical infrastructure, such as homeland security assignments,

11

emergency services facilities, hospitals, traffic signals,

12

wastewater treatment plants or telecommunications facilities,

13

provided that technical rules for operating generators

14

interconnected with facilities of an electric distribution

15

company, electric cooperative or municipal electric system have

16

been promulgated by the Institute of Electrical and Electronic

17

Engineers and the Pennsylvania Public Utility Commission.

"Net metering."  The means of measuring the difference

20

between the electricity supplied by an electric utility and the

21

electricity generated by a customer-generator when any portion

22

of the electricity generated by the alternative energy

23

generating system is used to offset part or all of the customer-

24

generator's requirements for electricity. Virtual meter

25

aggregation on properties owned or leased and operated by a

26

customer-generator and located within [two miles of the

27

boundaries of the customer-generator's property and within] a

28

single electric distribution company's service territory shall

29

be eligible for net metering.

Section 2.  This act shall take effect in 60 days.
