AN ACT

Providing for a siting restriction for assisted living

2

residences, nursing homes and personal care homes.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

Section 1.  Short title.

6

This act shall be known and may be cited as the Assisted

7

Living Residence, Nursing Home and Personal Care Home Siting

8

Restriction Act.

Section 2.  Definitions.

10

The following words and phrases when used in this act shall

11

have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

"Assisted living residence."  Any premises in which food,

14

shelter, personal care, assistance or supervision and

15

supplemental health care services are provided for a period

16

exceeding 24 hours for four or more adults who are unrelated to

17

the operator and who require assistance or supervision in such

18

matters as dressing, bathing, diet, financial management,

evacuation from the residence in the event of an emergency or

2

medication prescribed for self-administration.

"Nursing home."  Any premises in which nursing care and

4

related medical or other health services are provided, for a

5

period exceeding 24 hours, for two or more individuals, who are

6

unrelated to the operator, who are not acutely ill and not in

7

need of hospitalization, but who, because of age, illness,

8

disease, injury, convalescence or physical or mental infirmity,

9

need such care.

"Personal care home."  Any premises in which food, shelter

11

and personal assistance or supervision are provided for a period

12

exceeding 24 hours for four or more adults who are unrelated to

13

the operator, who do not require the services in or of a

14

licensed long-term care facility but who do require assistance

15

or supervision in such matters as dressing, bathing, diet,

16

financial management, evacuation of a residence in the event of

17

an emergency or medication prescribed for self-administration.

Section 3.  Assisted living residence, nursing home and personal

19

care home siting restriction.

20

A municipality shall adopt, amend and implement such

21

ordinances as are necessary to prohibit assisted living

22

residences, nursing homes and personal care homes in areas of

23

the municipality zoned for industrial use.

24

Section 4.  Effective date.

25

This act shall take effect in 60 days.
