AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in district and assistant

6

superintendents, further providing for salary and for

7

removal.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  Section 1075 of the act of March 10, 1949

11

(P.L.30, No.14), known as the Public School Code of 1949,

12

amended January 14, 1970 (1969 P.L.468, No.192), is amended to

13

read:

Section 1075.  Salary.--(a)  The board of school directors at

15

any convention electing a district superintendent or an

16

assistant district superintendent shall determine the amount of

17

salary to be paid such district superintendent or assistant

18

district superintendent which compensation shall be paid out of

19

the funds of the district. If a district superintendent or an

20

assistant district superintendent is employed in a joint school

system including kindergarten or grades 1 to 12, his salary

2

shall be fixed by a majority vote of all the school directors in

3

the districts operating the joint school systems, and shall be

4

paid by the districts in the same proportions as they contribute

5

to the support of the joint school.

(b)  District superintendents and assistant district

7

superintendents shall be entitled to the following minimum

8

annual salaries:

9

(1)  Assistant district superintendents having less than one

10

hundred (100) teachers under their supervision, nine thousand

11

dollars ($9,000).

(2)  Assistant district superintendents having one hundred

13

(100) teachers or more but less than three hundred (300)

14

teachers under their supervision, ten thousand dollars

15

($10,000).

(3)  Assistant district superintendents having three hundred

17

(300) or more teachers under their supervision, eleven thousand

18

dollars ($11,000).

19

(4)  District superintendents having less than one hundred

20

(100) teachers under their supervision, thirteen thousand

21

dollars ($13,000).

(5)  District superintendents having one hundred (100)

23

teachers or more but less than three (300) teachers under their

24

supervision, fourteen thousand dollars ($14,000).

(6)  District superintendents having three hundred (300) or

26

more teachers under their supervision, fifteen thousand dollars

27

($15,000).

(c)  Notwithstanding any other provision of this act or other

29

law to the contrary, a district superintendent or assistant

30

district superintendent who is removed from office under section

1080 shall not be entitled to receive any salary, or payment of

2

any kind in lieu of salary, from the school district after the

3

date of the majority vote of the board of school directors to

4

remove the district superintendent or assistant district

5

superintendent.

Section 2.  Section 1080 of the act is amended to read:

7

Section 1080.  Removal.--(a)  District superintendents and

8

assistant district superintendents may be removed from office,

9

after hearing, by a majority vote of the board of school

10

directors of the district, for neglect of duty, incompetency,

11

intemperance, or immorality, of which hearing notice of at least

12

one week has been sent by mail to the accused, as well as to

13

each member of the board of school directors.

(b)  A contract between a board of school directors and a

15

district superintendent or assistant district superintendent

16

shall be null and void after the date of the majority vote of

17

the board of school directors to remove the district

18

superintendent or assistant district superintendent under this

19

section.

20

Section 3.  This act shall apply to any contract entered into

21

on or after the effective date of this section.

22

Section 4.  This act shall take effect in 60 days.
