AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for definitions, for restricted

3

account, for registration of snowmobile or ATV, for

4

certificate of title for snowmobile or ATV, for fees and for

5

records; and providing for vintage snowmobile permits.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  The definition of "snowmobile" in section 7702 of

9

Title 75 of the Pennsylvania Consolidated Statutes is amended

10

and the section is amended by adding definitions to read:

11

§ 7702.  Definitions.

12

The following words and phrases when used in this chapter

13

shall have, unless the context clearly indicates otherwise, the

14

meanings given to them in this section:

"Snowmobile."  An engine-driven vehicle which is all of the

17

following:

18

(1)  Is designed to travel over snow or ice.

19

(2)  Has an endless belt track or tracks.

(3)  Is steered by a ski or skis.

2

(4)  Has an overall width of 48 inches or less.

The term does not include a farm tractor, construction

4

equipment, military vehicle, vehicle with inflatable tires or

5

machinery used strictly for the grooming of snowmobile trails.

The term includes vintage snowmobiles.

"Vintage snowmobile."  A snowmobile that is at least 25 years

9

of age and is not operated in this Commonwealth except at

10

vintage snowmobile events.

"Vintage snowmobile event."  A ride or rally intended for the

12

participation by vintage snowmobiles on a designated trail, on a

13

specific date and with a specified beginning and end point.

Section 2.  Section 7706(a)(1) of Title 75 is amended to

15

read:

§ 7706.  Restricted account.

17

(a)  Deposit and use of moneys.--

18

(1)  The department shall deposit the following into a

19

restricted account, which is hereby established:

20

(i)  all moneys received from the registration of and

21

issuance of certificates of title for snowmobiles and

22

ATV's and from the issuance of vintage snowmobile

23

permits;

24

(ii)  all revenue from the sale of any publications

25

or services relating to snowmobiles and ATV's; and

26

(iii)  all fines, penalties, fees and costs assessed

27

and collected as a result of enforcement activities

28

conducted by the department's law enforcement personnel

29

under this chapter.

Section 3.  The heading of Subchapter B of Chapter 77 of

Title 75 is amended to read:

SUBCHAPTER B

CERTIFICATES OF TITLE [AND REGISTRATION], REGISTRATION AND

5

PERMITS

Section 4.  Section 7711.1(f) of Title 75 is amended by

7

adding a paragraph to read:

§ 7711.1.  Registration of snowmobile or ATV.

9

(f)  Exemptions from registration.--Subsection (a) does not

11

apply if:

12

(5)  The snowmobile is a vintage snowmobile and the owner

14

thereof carries a valid vintage snowmobile permit.

15

Section 5.  Sections 7712.1(g), 7715.2(a) and 7716 of Title

16

75 are amended to read:

17

§ 7712.1.  Certificate of title for snowmobile or ATV.

(g)  Registration without certificate of title prohibited.--

20

Except as provided in subsection (b), the department shall not

21

issue a registration certificate or limited registration

22

certificate for a snowmobile or ATV or a vintage snowmobile

23

permit for a vintage snowmobile unless a certificate of title

24

has been issued by the department to the owner or an application

25

for a certificate of title has been delivered by the owner to

26

the department.

§ 7715.2.  Fees.

29

(a)  Fees.--Except as provided in subsection (b), the

30

department shall collect the following fees:

(1)  Certificate of title, $22.50.

(2)  Expiration sticker, $20.

3

(2.1)  Vintage snowmobile permit, $10.

4

(3)  Dealer registration, $25.

5

(4)  Replacement, due to loss or damage, of registration

6

certificate, limited registration certificate, registration

7

decal, registration plate [or], expiration sticker or vintage

8

snowmobile permit, $5.

9

(5)  Transfer of registration pursuant to section 7711.1

10

(relating to registration of snowmobile or ATV), $5.

11

(6)  Recording the name of a secured party on a

12

certificate of title, $5.

§ 7716.  Records.

15

The department shall maintain a record, which shall be made

16

available to all enforcement agencies, of:

17

(1)  The registration number for each snowmobile and ATV

18

for which a registration certificate or limited registration

19

certificate is issued.

20

(2)  The name and address of the owner of each snowmobile

21

and ATV for which a registration certificate or limited

22

registration certificate is issued.

23

(3)  The permit number for each vintage snowmobile for

24

which a vintage snowmobile permit is issued.

25

(4)  The name and address of the owner of each vintage

26

snowmobile for which a vintage snowmobile permit is issued.

Section 6.  Title 75 is amended by adding a section to read:

28

§ 7718. Vintage snowmobile permits.

29

(a)  Issuance of permits.--Upon receipt of an application

30

upon a form prescribed and furnished by the department which

shall contain information required by the department and which

2

shall be accompanied by the required fee and any other

3

information the department shall require, the department shall

4

issue to an owner of a vintage snowmobile a vintage snowmobile

5

permit containing a permit number.

(b)  Carrying and exhibiting permit.--Every permit shall, at

7

all times while the vehicle is being operated, be in the

8

possession of the person driving or in control of the vehicle or

9

carried in the vehicle and shall be exhibited on demand of a

10

police officer or authorized department employee.

11

(c)  Not transferable.--A vintage snowmobile permit is not

12

transferable to a successor owner or to another vehicle. On

13

transfer of ownership of a vintage snowmobile for which a

14

vintage snowmobile permit has been issued, the permit shall

15

become invalid.

16

(d)  Suspension or revocation.--The department may suspend or

17

revoke a vintage snowmobile permit upon conviction of the holder

18

of an offense under this chapter. A suspended or revoked vintage

19

snowmobile permit is invalid.

20

Section 7.  This act shall take effect in 30 days.
