AN ACT

Amending Title 24 (Education) of the Pennsylvania Consolidated

Statutes, in retirement for school employees, further

providing for mandatory and optional membership.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 8301(a)(2) of Title 24 of the

Pennsylvania Consolidated Statutes, amended November 23, 2010

(P.L.1269, No.120), is amended to read:

§ 8301.  Mandatory and optional membership.

(a)  Mandatory membership.--Membership in the system shall be

mandatory as of the effective date of employment for all school

employees except the following:

(2)  Any school employee who is not a member of the

system and who is employed on a per diem or hourly basis for

less than 80 full-day sessions or [500] 1,000 hours in any

fiscal year or annuitant who returns to school service under

the provisions of section 8346(b) (relating to termination of

annuities).

Section 2.  This act shall take effect in 60 days.
