AN ACT

Amending Title 4 (Amusements) of the Pennsylvania Consolidated

Statutes, further providing for license or permit application

3

hearing process and public input hearings.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 1205 of Title 4 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 1205.  License or permit application hearing process; public

9

input hearings.

(c)  Referendum.--

12

(1)  The board may not license a facility under this part

13

unless a majority of the electors voting on the question

14

required under this subsection vote in the affirmative.

15

(2)  Following the conclusion of all public hearings held

16

under subsection (a), the municipality where the facility

17

will be located shall place a question on the ballot at the

next municipal election.

(3)  The referendum question must state that a facility

3

is proposed for the electors' municipality and that the board

4

may only issue a license if a majority of the electors voting

5

on the question approve. The question shall be in clear

6

language that is readily understandable by a layperson.

(4)  Proceedings under this subsection shall be in

8

accordance with the provisions of the act of June 3, 1937

9

(P.L.1333, No.320), known as the Pennsylvania Election Code.

10

Section 2.  The addition of 4 Pa.C.S. § 1205(c) shall apply

11

to any slot machine license application filed on or after the

12

effective date of this section.

Section 3.  This act shall take effect immediately.
