AN ACT

Amending Title 51 (Military Affairs) of the Pennsylvania

2

Consolidated Statutes, in military leave of absence, further

3

providing for educational leave of absence.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 7313 of Title 51 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 7313.  Educational leave of absence.

9

(a)  General rule.--Whenever any member of the Pennsylvania

10

National Guard or other reserve component of the armed forces of

11

the United States shall be called or ordered to active duty,

12

other than active duty for training, including, in the case of

13

members of the Pennsylvania National Guard, active State duty,

14

the educational institution in which the member is enrolled

15

shall grant the member a military leave of absence from [their] 

16

the member's education. Persons on military leave of absence

17

from their educational institution shall be entitled, upon

release from military duty, to be restored to the educational

2

status they had attained prior to their being ordered to

3

military duty without loss of academic credits earned,

4

scholarships or grants awarded or tuition and other fees paid

5

prior to the commencement of the military duty.

(b)  Change in degree requirements.--If the requirements to

7

obtain a degree change while a member is on active duty with the

8

Pennsylvania National Guard or the reserve components of the

9

armed forces of the United States, the member shall have the

10

right to pursue the member's academic degree under the new

11

requirements or the requirements in place prior to the member's

12

call or order to active duty, other than active duty for

13

training, including, in the case of a member of the Pennsylvania

14

National Guard, active State duty.

(c)  Notice of rights.--Upon the return of a member of the

16

Pennsylvania National Guard or the reserve components of the

17

armed forces of the United States from active duty to an

18

educational institution, the educational institution shall

19

advise the member in writing or through electronic mail of the

20

member's rights under this section.

21

(d)  Refunds or credits of tuition and fees paid.--It shall

22

be the duty of the educational institution to refund tuition or

23

fees paid or to credit the tuition and fees to the next semester

24

or term after the termination of the educational military leave

25

of absence at the option of the student.

26

Section 2.  This act shall take effect in 60 days.
