AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, further providing for cruelty to

3

animals.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 5511(q) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended by adding definitions and the

8

section is amended by adding a subsection to read:

§ 5511.  Cruelty to animals.

(c.1)  Use of live animals or fowl for targets at trap shoot

12

or block shoot prohibited.--

13

(1)  A person commits a summary offense if that person

14

willfully organizes, operates or conducts a trap shoot or

15

block shoot in which live animals or fowl are used as

16

targets.

(2)  Nothing in this subsection shall be construed to

apply to any activity which is authorized or permitted under

2

34 Pa.C.S. (relating to game) or a special permit under 58

3

Pa. Code Ch. 147 (relating to special permits).

(q)  Definitions.--As used in this section, the following

6

words and phrases shall have the meanings given to them in this

7

subsection:

"Fowl."  A bird, except game birds as defined and regulated

10

under 34 Pa.C.S. § 102 (relating to definitions).

"Trap shoot" or "block shoot."  An event during which

13

participants shoot or attempt to shoot targets that are:

14

(1)  launched or otherwise immediately presented to the

15

shooter with electronic or mechanical assistance from a fixed

16

location or locations within a predefined shooting field; or

17

(2)  affixed to a rope, chain or other tethering device

18

when presented to the shooter.

Section 2.  This act shall take effect in 60 days.
