AN ACT

Amending the act of November 10, 1999 (P.L.491, No.45), entitled

2

"An act establishing a uniform construction code; imposing

3

powers and duties on municipalities and the Department of

4

Labor and Industry; providing for enforcement; imposing

5

penalties; and making repeals," further providing for revised

6

or successor codes; and providing for report.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Section 304(a) of the act of November 10, 1999

10

(P.L.491, No.45), known as the Pennsylvania Construction Code

11

Act, amended October 9, 2008 (P.L.1386, No.106), is amended to

12

read:

13

Section 304.  Revised or successor codes.

14

(a)  Building code.--

15

(1)  Subject to sections 105(c) and (d), 301(a)(3), (4),

16

(5), (6) and (7), (c) and (d) and 302, by December 31 of the

17

year of the issuance of a new triennial ICC International

18

Building Code, or its successor building code, the department

19

shall promulgate regulations adopting the new code as the

Uniform Construction Code unless the council informs the

2

department that it should exclude any provisions of the

3

triennial code from the Uniform Construction Code. If the

4

council provides this notification, the department shall

5

submit regulations adopting the triennial code with

6

provisions omitted by the council under this section within

7

90 days following council notification.

(2)  Subject to sections 105(c) and (d), 301(a)(3), (4),

9

(5), (6) and (7), (c) and (d) and 302, by December 31 of the

10

year of issuance of a new triennial ICC International

11

Residential Code, or its successor building code, the

12

department shall promulgate regulations providing that all

13

detached one-family and two-family dwellings and one-family

14

townhouses that are not more than three stories in height and

15

their accessory structures may be designed in accordance with

16

that code or the Uniform Construction Code at the option of

17

the building permit applicant. The department shall

18

promulgate regulations adopting the new code as the Uniform

19

Construction Code unless the council informs the department

20

that it should exclude any provisions of the triennial code

21

from the Uniform Construction Code. If the council provides

22

this notification, the department shall submit regulations

23

adopting the triennial code with provisions omitted by the

24

council under this section within 90 days following council

25

notification.

(3)  Notwithstanding the provisions of paragraphs (1) and

27

(2), the regulations adopting the 2009 ICC International

28

Building Code or the 2009 International Residential Code are

29

abrogated, and the department shall promulgate regulations

30

reinstating the 2006 versions of those codes, which shall

remain in effect until December 31, 2012, and until such time

2

as the department shall adopt the 2012 triennial versions of

3

those codes pursuant to paragraphs (1) and (2).

Section 2.  The act is amended by adding a section to read:

5

Section 1101.1.  Report.

6

The Legislative Budget and Finance Committee shall undertake

7

a comprehensive review of this act and submit a report on its

8

findings to the Labor and Industry Committee of the Senate and

9

the Labor Relations Committee of the House of Representatives

10

within one year of the effective date of this section. The

11

review shall include:

12

(1)  The process by which the International Code Council

13

adopts changes to its codes and subcodes.

14

(2)  Costs and benefits of triennial adoption of the

15

Uniform Construction Code.

16

(3)  The composition of the Uniform Construction Code

17

Review and Advisory Council and the process by which it

18

reviews and recommends changes to this act.

19

(4)  The process of administration and enforcement of the

20

Uniform Construction Code.

21

(5)  The fee structure of the Uniform Construction Code.

22

(6)  The process, including time frames, by which the

23

department adopts the Uniform Construction Code.

24

Section 3.  This act shall take effect in 60 days.
