REFERRED TO PUBLIC HEALTH AND WELFARE, FEBRUARY 16, 2011  

AN ACT

Amending the act of April 14, 1972 (P.L.233, No.64), entitled

"An act relating to the manufacture, sale and possession of

controlled substances, other drugs, devices and cosmetics;

conferring powers on the courts and the secretary and

Department of Health, and a newly created Pennsylvania Drug,

Device and Cosmetic Board; establishing schedules of

controlled substances; providing penalties; requiring

registration of persons engaged in the drug trade and for the

revocation or suspension of certain licenses and

registrations; and repealing an act," providing for the

definitions of "clinical trial" and "pharmaceutical drug."

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 2 of the act of April 14, 1972 (P.L.233,

No.64), known as The Controlled Substance, Drug, Device and

Cosmetic Act, is amended by adding definitions to read:

Section 2.  Definitions.--(a)  The definitions contained and

used in the "Pennsylvania Drug and Alcohol Abuse Control Act"

shall also apply for purposes of this act.

(b)  As used in this act:

Clinical trial" means the same as the term "applicable drug

clinical trial" in section 402(j)(1)(A)(iii)(I) of the Public

Health Services Act (58 Stat. 682, 42 U.S.C. § 282(j)(1)(A)(iii)

(I)).

"Pharmaceutical drug and biologic" means any drug which is

approved by the United States Food and Drug Administration and

which is commercially available for dispensing with a

prescription.

Section 2.  This act shall take effect in 180 days.
