REFERRED TO VETERANS AFFAIRS AND EMERGENCY PREPAREDNESS, FEBRUARY 8, 2011  

AN ACT

Amending the act of August 9, 1955 (P.L.323, No.130), entitled,

as amended, "An act relating to counties of the first, third,

fourth, fifth, sixth, seventh and eighth classes; amending,

revising, consolidating and changing the laws relating

thereto; relating to imposition of excise taxes by counties,

including authorizing imposition of an excise tax on the

rental of motor vehicles by counties of the first class; and

providing for regional renaissance initiatives," in special

powers and duties of counties, further providing for flags to

decorate graves.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 1922(d) of the act of August 9, 1955

(P.L.323, No.130), known as The County Code, amended June 12,

1986 (P.L.253, No.66), is amended to read:

Section 1922.  Flags to Decorate Graves.--* * *

(d)  The authorities in charge of any cemetery are authorized

to remove such flags when the same become unsightly or

weatherworn at any time not before the first working day after

Independence Day of each year: Provided, however, That the flag

holders for such flags may not be removed for any reason at any

time unless the flag holders are immediately replaced with new

flag holders.

Section 2.  This act shall take effect in 60 days.
