| AN ACT |
| |
1 | Amending the act of August 9, 1955 (P.L.323, No.130), entitled, |
2 | as amended, "An act relating to counties of the first, third, |
3 | fourth, fifth, sixth, seventh and eighth classes; amending, |
4 | revising, consolidating and changing the laws relating |
5 | thereto; relating to imposition of excise taxes by counties, |
6 | including authorizing imposition of an excise tax on the |
7 | rental of motor vehicles by counties of the first class; and |
8 | providing for regional renaissance initiatives," further |
9 | providing for applicability and for the abolishment of the | <-- |
10 | office of jury commissioner. |
11 | The General Assembly of the Commonwealth of Pennsylvania |
12 | hereby enacts as follows: |
13 | Section 1. Section 401 of the act of August 9, 1955 | <-- |
14 | (P.L.323, No.130), known as The County Code, is amended by |
15 | adding a subsection to read: |
16 | Section 1. Section 102(a) of the act of August 9, 1955 | <-- |
17 | (P.L.323, No.130), known as The County Code, amended July 14, |
18 | 2005 (P.L.312, No.57), is amended to read: |
19 | Section 102. Applicability.--(a) Except incidentally, as in |
20 | sections 108, 201, 210, 211, 401 and 1401 or as provided in |
21 | Article XXX, this act does not apply to counties of the first, |

1 | second A, or second classes. |

3 | Section 2. Section 401 of the act is amended by adding a |
4 | subsection to read: |
5 | Section 401. Enumeration of Elected Officers.--* * * |
6 | (f) After review of the procedures in effect within the |
7 | county to ensure that lists of potential jurors are a |
8 | representative cross section of the community, the governing |
9 | body of a county of the second class A or third through eighth | <-- |
10 | class may adopt, by a majority vote, a resolution abolishing the |
11 | office of jury commissioner. Upon approval of the resolution, |
12 | the office of jury commissioner shall expire at the completion |
13 | of the current jury commissioners' terms of office. The |
14 | resolution shall not be passed in any year in which the office |
15 | of jury commissioner is on the ballot. |
