| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | executive and administrative work of the Commonwealth by the |
4 | Executive Department thereof and the administrative |
5 | departments, boards, commissions, and officers thereof, |
6 | including the boards of trustees of State Normal Schools, or |
7 | Teachers Colleges; abolishing, creating, reorganizing or |
8 | authorizing the reorganization of certain administrative |
9 | departments, boards, and commissions; defining the powers and |
10 | duties of the Governor and other executive and administrative |
11 | officers, and of the several administrative departments, |
12 | boards, commissions, and officers; fixing the salaries of the |
13 | Governor, Lieutenant Governor, and certain other executive |
14 | and administrative officers; providing for the appointment of |
15 | certain administrative officers, and of all deputies and |
16 | other assistants and employes in certain departments, boards, |
17 | and commissions; and prescribing the manner in which the |
18 | number and compensation of the deputies and all other |
19 | assistants and employes of certain departments, boards and |
20 | commissions shall be determined," providing for General |
21 | Assembly general appropriation procedure; and further |
22 | providing for revenue estimates. |
23 | The General Assembly of the Commonwealth of Pennsylvania |
24 | hereby enacts as follows: |
25 | Section 1. The act of April 9, 1929 (P.L.177, No.175), known |
26 | as The Administrative Code of 1929, is amended by adding a |
27 | section to read: |
28 | Section 613.1. General Assembly General Appropriation |

1 | Procedure.--(a) The following deadlines are imposed: |
2 | (1) No later than six weeks after the date of submission of |
3 | the budget by the Governor to the General Assembly under section |
4 | 619(b), a separate general appropriation bill shall be |
5 | introduced in each chamber of the General Assembly. |
6 | (2) Each chamber of the General Assembly shall pass a |
7 | general appropriation bill no later than the first full week in |
8 | May, except in a fiscal year when the Governor is inaugurated, |
9 | in which case each chamber shall pass a general appropriation |
10 | bill no later than the second full week of May. |
11 | (3) A final general appropriation bill shall be passed by |
12 | the General Assembly and presented to the Governor for signature |
13 | no later than June 30 of the same fiscal year in which the bill |
14 | was introduced. |
15 | (4) If the Governor vetoes the general appropriation bill |
16 | passed under paragraph (3) and the veto is not overridden, |
17 | another general appropriation bill shall be passed by the |
18 | General Assembly and presented to the Governor for signature |
19 | within two weeks of the date of the veto. |
20 | (b) Failure to meet any of the deadlines set forth in |
21 | subsection (a) shall: |
22 | (1) result in forfeiture of pay by the members of the |
23 | chamber of the General Assembly that failed to meet the |
24 | deadline, along with forfeiture of the per diem allowances and |
25 | legislative expense reimbursements for lodging, meals and |
26 | mileage applicable to the members of that chamber; and |
27 | (2) require the physical presence in the Main Capitol |
28 | Building of all members of the chamber that failed to meet the |
29 | deadline, until the objective of the unmet deadline has been |
30 | attained. |

1 | Section 2. Section 618 of the act is amended by adding a |
2 | subsection to read: |
3 | Section 618. Revenue Estimates.--* * * |
4 | (a.1) The Department of Revenue, in conjunction with the |
5 | Secretary of the Budget, shall make revenue estimates and |
6 | periodic revisions available for use by the General Assembly in |
7 | preparing a budget until the final estimate is signed by the |
8 | Governor, which shall occur no later than the date on which the |
9 | Governor signs the general appropriation bill. The initial |
10 | estimate shall be available by the second week of February each |
11 | year and at least one revised estimate shall be available no |
12 | later than May 1. |
