| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," providing for workers' compensation |
6 | safety committees. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of March 10, 1949 (P.L.30, No.14), known |
10 | as the Public School Code of 1949, is amended by adding a |
11 | section to read: |
12 | Section 615. Workers' Compensation Safety Committee.--(a) |
13 | Each school district shall have and maintain a certified safety |
14 | committee by December 31, 2012, for the purposes of section |
15 | 1002(b) of the act of June 2, 1915 (P.L.736, No.338), known as |
16 | the "Workers' Compensation Act." The Department of Labor and |
17 | Industry shall annually provide the Department of Education with |
18 | the list of school districts who have a certified safety |
19 | committee. In the case of a school district that does not comply |

1 | with this section, the Department of Education shall annually |
2 | deduct from any allocation from the Commonwealth to which the |
3 | school district is entitled the amount of the discount the |
4 | school district would otherwise receive under section 1002(b) of |
5 | the "Workers' Compensation Act." |
6 | (b) This section shall not apply to a school district that |
7 | would not qualify for the discount under section 1002(b) of the |
8 | "Workers' Compensation Act" by virtue of the establishment of a |
9 | certified safety committee. |
10 | Section 2. This act shall take effect July 1, 2011. |
